企业间合作创新知识产权风险控制研究

【摘要】:合作创新作为企业提升创新能力、增强核心竞争力的有效途径,其过程中伴随的知识产权风险严重阻碍着企业合作创新的构建与运行。如何识别、评估与控制合作创新中的知识产权风险成为了企业关注的焦点。 本研究以企业间合作创新为研究对象,运用理论分析和实证研究相结合的方法,以企业间合作创新和知识产权风险管理的相关理论为指导,构建合作创新知识产权风险影响因素概念模型,运用系统动力学理论分析各影响因素的作用机理,设计调查问卷,,对模型有效性进行检验,最后进行仿真模拟。 本文的企业间合作创新知识产权风险影响因素概念模型从外部环境、合作创新主体以及合作创新客体三个维度进行。外部环境因素细分为经济发展水平、国家知识产权法律制度、社会知识产权保护意识;合作创新主体因素细分为企业高层的管理能力、员工的流动频率、企业知识产权保护制度、成员间的信任程度、合作契约的完备性、合作动机;合作创新客体因素细分为无形资产获取与维持成本、无形资产分类测量的明晰度。分析了影响因素之间的因果关系,构建了企业间合作创新知识产权风险系统的因果回路图,建立了合作创新知识产权风险的系统动力学模型。在系统动力学模型的基础上,设计了调查问卷,调查了100家山西省参与过合作创新的企业高层管理者,运用Vensim软件对合作创新知识产权风险的系统动力学模型进行有效性检验和仿真研究。 通过仿真研究发现,合作时间越长,合作双方面临的知识产权风险呈下降趋势,并且在外部环境因素中社会知识产权保护意识对风险影响最大,经济发展水平影响最小;在合作创新主体因素中员工的流动频率对风险影响最大,合作动机影响最小;在合作创新客体因素中无形资产获取与维持成本对风险影响最大,无形资产分类测量的明晰度影响最小。
[Abstract]:Cooperative innovation is an effective way for enterprises to enhance their innovation ability and enhance their core competitiveness. The intellectual property risk associated with it seriously hinders the construction and operation of cooperative innovation. How to identify, evaluate and control the intellectual property risk in cooperative innovation has become the focus of attention. This study takes cooperative innovation among enterprises as the research object, applies the method of theoretical analysis and empirical research, and takes the relevant theories of inter-firm cooperative innovation and intellectual property risk management as the guidance. The conceptual model of the influencing factors of intellectual property rights risk of cooperative innovation is constructed, and the mechanism of influencing factors is analyzed by using the system dynamics theory. A questionnaire is designed to test the validity of the model. Finally, the simulation is carried out. The conceptual model of influencing factors of intellectual property right risk of inter-firm cooperative innovation is carried out from three dimensions: external environment, cooperative innovation subject and cooperative innovation object. The external environmental factors are divided into the level of economic development, the national intellectual property legal system, the awareness of social intellectual property protection, the main factors of cooperation and innovation are divided into the management ability of the senior level of the enterprise, the frequency of staff flow, The system of intellectual property protection, the degree of trust among members, the completeness of cooperation contract, the motive of cooperation, the object factors of cooperative innovation are divided into intangible assets acquisition and maintenance cost, and the clarity of intangible assets classification and measurement. This paper analyzes the causal relationship among the factors, constructs the causal circuit diagram of the risk system of cooperative innovation intellectual property rights among enterprises, and establishes the system dynamics model of the risk of cooperative innovation intellectual property rights. Based on the system dynamics model, a questionnaire was designed to investigate 100 senior managers of Shanxi province who had participated in cooperative innovation. In this paper, Vensim software is used to test and simulate the system dynamics model of intellectual property risk of cooperative innovation. Through the simulation study, it is found that the longer the cooperation time, the lower the risk of intellectual property rights faced by both partners, and the social intellectual property protection consciousness has the greatest impact on the risk and the least impact on the level of economic development among the external environmental factors. Among the main factors of cooperative innovation, the frequency of employee mobility has the greatest impact on risk, while the motivation of cooperation has the least effect on the risk, and the cost of acquisition and maintenance of intangible assets has the greatest impact on risk among the factors of object of cooperative innovation. The clarity of intangible assets classification measurement has the least influence.
