论技术标准中专利的保护与限制

【摘要】：随着经济一体化的不断加深,技术标准作为联系各地区行业领域的技术纽带与知识产权的结合愈加紧密。我国在经济发展过程中也不断加快标准化进程,使得我国技术标准与知识产权结合问题更加重要。目前我国大多数学者在研究技术标准中的知识产权问题上,大多着眼于如何利用现有的法律制度限制专利权的滥用问题,然而如果只一味思考如何限制对手的知识产权战略而不融入其中积极参与竞争,这只会使得中国的企业们永远处于跟随外国企业的步伐亦步亦趋的被动地位,因此,中国企业应提高自主创新意识,积极参与我国标准化活动,以提升企业的国际竞争实力。技术标准是一种公共产品,随着知识经济的进步,对公共领域内的私有性知识产权加以保护却又能保持市场竞争的良好秩序,这是值得标准的制定者和学者们认真思考的问题。笔者通过比较研究、价值衡量和案例分析的方法对技术标准中专利权的保护与限制问题予以探讨、分析,从这二者相互融合的动因入手分析技术标准与专利权在本质属性上的一致性,明确技术标准与专利的结合是科技进步与经济发展的必然趋势;另一方面,通过以利益平衡原则为理论基础,建立起有效的技术标准与专利的协调机制,从完善我国关于技术标准中涉及专利的法律制度以及建立技术标准的专利审查机制两方面缓和二者的矛盾冲突,加快我国标准化进程,为未来中国企业的发展、中国经济的发展做一些力所能及的努力,提出相关的法律意见。
[Abstract]:With the deepening of economic integration, technical standards are becoming more and more closely linked with intellectual property. In the process of economic development, China also accelerates the process of standardization, which makes the integration of technical standards and intellectual property more important. At present, most scholars in our country are focusing on how to use the existing legal system to limit the abuse of patent right in the research of intellectual property rights in technical standards. However, if we only think about how to restrict our competitors' intellectual property strategy without actively participating in the competition, it will only keep Chinese enterprises in a passive position of following the footsteps of foreign enterprises, so, Chinese enterprises should improve their consciousness of independent innovation and actively participate in the standardization activities of our country in order to enhance the international competitive strength of enterprises. Technical standard is a kind of public goods. With the progress of knowledge economy, the private intellectual property rights in the public domain can be protected while maintaining a good order of market competition, which is a problem worthy to be seriously considered by the standard-setters and scholars. By means of comparative study, value measurement and case study, the author discusses the protection and limitation of patent right in technical standard. It is the inevitable trend of scientific and technological progress and economic development to analyze the consistency of technical standard and patent right on the essential attribute from the motive of the fusion of the two, and to make clear the combination of technical standard and patent; on the other hand, it is the inevitable trend of scientific and technological progress and economic development. By taking the principle of balance of interests as the theoretical basis and establishing an effective coordination mechanism between technical standards and patents, From the aspects of perfecting the legal system concerning patents in technical standards and establishing the patent examination mechanism of technical standards, the contradiction and conflict between the two should be alleviated, and the process of standardization in our country should be quickened so as to promote the development of Chinese enterprises in the future. China's economic development to make some efforts within the limits of the relevant legal advice.
