旅游产品知识产权保护研究

【摘要】:二十一世纪不仅是旅游经济飞速发展的时期,也是知识经济发展的时代。我国旅游业近年来发展势头较好,带动着相关产业的蓬勃发展,在促进社会经济发展和产业链条良性发展方面扮演着越来越重要的角色。中国旅游业取得的成绩虽然令人注目,但是在发展过程中也出现了很多问题,这些问题严重阻碍了旅游业更进一步的发展。其中,旅游产品的知识产权保护问题就是比较突出的一大方面。旅游产品的内容较多,具有综合性的特点,这样就决定了旅游产品知识产权的保护必须运用多样性的方法,同时也代表着旅游知识产权保护将会是一个系统的工程。面对日趋激烈的旅游行业竞争,要做好这样一个系统工程就需要旅游经营者可以全面的运用知识产权,从著作、商标、专利各方面来维护自己的合法权利,从而使自己在竞争中获得优势。这就是本文所要探讨的基本问题—旅游产品的知识产权保护。 本文共分为三大部分。第一部分“旅游产品知识产权保护概述”主要探讨旅游产品如何界定及其法律属性、旅游产品知识产权保护的基本途径和旅游产品知识产权保护的意义三大方面。因旅游产品定义较多,本文所研究的旅游产品仅限于旅游经营者经营的旅游产品,其核心要素是旅游服务。在了解旅游产品概念的基础上指出保护旅游产品知识产权对促进旅游业发展的重要意义。 第二部分“旅游产品知识产权保护现状分析”主要就目前我国旅游产品知识产权保护中出现的著作权、商标权、专利权问题和有无违反反不正当竞争法的内容问题进行阐述。以知识产权法为标准,对旅游产品知识产权保护体系中涉及的知识产权问题详细分析。 第三部分“加强旅游产品知识产权保护的对策”是整个文章的重点部分。在前两章基本内容和现状的阐述下,分析目前对于我国旅游产品知识产权保护方面可以采取的对策。主要包括提高旅游产品知识产权的保护意识、在目前我国知识产权法律框架体系内,正确运用知识产权法律保护,建立健全权责体系和加强旅游产品知识产权保护执法制度三大方面。
[Abstract]:The 21 century is not only the period of rapid development of tourism economy, but also the era of knowledge economy development. In recent years, China's tourism industry has a good development momentum, driving the vigorous development of related industries, and playing a more and more important role in promoting the social and economic development and the benign development of the industrial chain. Although the achievements of Chinese tourism are remarkable, there are many problems in the process of development, which seriously hinder the further development of tourism. Among them, the intellectual property protection of tourism products is a relatively prominent aspect. The content of tourism products is more and has the comprehensive characteristics, which determines the protection of intellectual property rights of tourism products must use a variety of methods, but also represents that the protection of tourism intellectual property rights will be a systematic project. In the face of the increasingly fierce competition in the tourism industry, in order to do such a systematic project well, it is necessary for tourism operators to fully use intellectual property rights to safeguard their legal rights from the aspects of books, trademarks and patents. Thus make oneself gain advantage in competition. This is the basic problem to be discussed in this paper-the protection of intellectual property rights of tourism products. This paper is divided into three parts. The first part "Overview of intellectual property protection of tourism products" mainly discusses how to define tourism products and their legal attributes, the basic ways to protect intellectual property rights of tourism products and the significance of intellectual property protection of tourism products. Because there are many definitions of tourism products, the tourism products studied in this paper are limited to tourism products operated by tour operators, whose core element is tourism service. On the basis of understanding the concept of tourism products, this paper points out the importance of protecting the intellectual property rights of tourism products to promote the development of tourism. The second part, "Analysis of the present situation of intellectual property protection of tourism products", mainly expounds the problems of copyright, trademark, patent right and the content of the violation of anti-unfair competition law in the protection of intellectual property rights of tourism products in our country at present. Based on the intellectual property law, this paper analyzes the intellectual property rights in the system of intellectual property protection of tourism products in detail. The third part is the key part of the whole article, which is to strengthen the protection of intellectual property rights of tourism products. Based on the analysis of the basic contents and present situation of the first two chapters, this paper analyzes the countermeasures that can be taken to protect the intellectual property rights of tourism products in China. It mainly includes raising the awareness of intellectual property protection of tourism products, correctly applying intellectual property legal protection within the current legal framework of intellectual property rights in our country. Establish and perfect the system of rights and responsibilities and strengthen the law enforcement system of intellectual property protection of tourism products.
