电视节目模板的知识产权保护模式研究

【摘要】：电视节目模板产业基于其可观的经济价值、丰富的文化价值及重大的创新价值,逐步发展成为新兴的文化创意产业。然而,由于对电视节目模板定性的不确定、法制的不完善,近年来模仿与抄袭现象频繁,严重阻碍了电视节目模板产业的发展,因此对于电视节目模板概念的界定以及对于电视节目模板侵权认定、裁量标准和救济措施等方面的问题亟待研究解决。本文通过理论研究与实证比较的方法,围绕电视节目模板的法律概念和法律定性模糊、国外电视节目模板保护模式介绍以及我国电视节目模板知识产权保护完善这三个中心问题,介绍并分析国内外有关电视节目模板纠纷的案例,通过比较研究,总结归纳世界各国在电视节目模板个案中,对其法律地位的认定,分析知识产权保护模式的运用原则与方法；其次,按照电视节目行业的发展现状和创新需求,将电视节目模板与知识产权相关概念,如商业秘密、商标、作品的概念进行对比,进而探讨以著作权法、反不正当竞争法、商标法、商业秘密保护电视节目模板的可操作性与实际方法,并基于以上的分析,重点提出了在立法上通过司法解释,建立新作品类型的具体法条及解释,在司法上认定著作权法的主体地位、判定实质性相似的原则以及如何适用反不正当竞争法。最终对完善我国电视节目模板知识产权保护提出了建议,即以著作权法为主,通过司法解释将电视节目模板纳入著作权法保护范围,以反不正当竞争法为辅,通过实质相似原则进行侵权认定,并加强知识产权管理、行政管理,构建立法、司法、行政、企业四位一体的法律保护模式。以期创造良好的电视节目模板产业的法律保护环境,切实有效的解决争议与纠纷,遏制非法抄袭与恶性竞争,保护权利人并维护广大群众的利益,提升电视节目模板创意文化产业的创新精神与活力,促进电视节目模板交易的稳健有序发展。
[Abstract]:Based on its considerable economic value, rich cultural value and significant innovation value, TV program template industry has gradually developed into a new cultural and creative industry. However, because of the uncertainty of the quality of the TV program template and the imperfection of the legal system, the phenomenon of imitation and plagiarism is frequent in recent years, which seriously hinders the development of the TV program template industry. Therefore, the definition of TV program template, as well as the infringement of TV program template, discretion standards and relief measures need to be solved. This paper focuses on the legal concept and legal qualitative ambiguity of TV program template by means of theoretical research and empirical comparison. The foreign TV program template protection mode introduction and our country television program template intellectual property protection consummate these three central questions, introduces and analyzes the domestic and foreign related television program template dispute case, through the comparative research, This paper summarizes and summarizes the determination of the legal status of TV program template cases in the world, and analyzes the application principles and methods of intellectual property protection model. Finally, some suggestions are put forward to perfect the intellectual property protection of TV program template in our country, that is, the copyright law should be the main part, the TV program template should be brought into the protection scope of copyright law through judicial interpretation, and the anti-unfair competition law should be taken as the supplement. Through the principle of substantial similarity to identify infringement, and strengthen intellectual property management, administration, construction of legislation, justice, administration, enterprise four-in-one legal protection model. With a view to creating a good legal protection environment for the TV program template industry, effectively resolving disputes and disputes, curbing illegal plagiarism and vicious competition, protecting the right holders and safeguarding the interests of the masses, To promote the innovative spirit and vitality of TV program template creative culture industry and promote the steady and orderly development of TV program template trade.
