虚拟财产权利属性研究

【摘要】：近年来，网络游戏产业已然占据着网络产业的主导地位。随着网络时代的来临，人们除了可以在现实世界中拥有财产外，在虚拟的网络世界中也逐渐拥有了“财产”，如网络游戏中的虚拟装备，虚拟货币等。游戏玩家之间虚拟财产的交易便随之而生，由此引发的纠纷也日益增多，如何正确认定上述交易行为的法律性质己成为当前理论研究的热点。但目前我国法律在虚拟财产领域的相关规定却是一片空白，对网络虚拟财产的界定也是模糊不清，因而导致在处理网络虚拟财产纠纷时的立法缺失和司法认定上的困难。因此，本文主要针对网络虚拟财产的法律保护问题从以下几个部分进行具体研究： 第一部分肯定了虚拟空间的存在价值。该部分通过引用戈夫曼的“拟剧论”以及哈贝马斯的交往行为理论论证了虚拟空间存在的价值意义，，指出既要肯定网络交往行为的合理性也应加强网络交往行为的规范化。同时这也是本文的创新点； 第二部分认为虚拟物品属于财产范畴，具有财产属性。首先对虚拟财产的概念进行定位，再分别介绍了学界在广义层面和狭义层面对虚拟财产的定义以及保护虚拟财产的必要性。然后具体分析了虚拟财产财产属性的否定学说和肯定学说，引用边沁和洛克的观点用以证明虚拟财产属于劳动成果，并从价值性、稀缺性以及可流通性等方面具体解读了虚拟财产的财产属性； 第三部分探讨虚拟财产的权利属性。作为本文的研究重点，分别对知识产权学说、债权学说以及物权学说进行了评价和分析。通过将虚拟财产与传统意义上物的属性进行比较，肯定了虚拟财产的物权属性； 本文最后主要解析了虚拟财产的权利归属及立法现状，并结合一些国家和地区的虚拟财产法律保护措施对我国相应的立法、司法完善提出建议。 本文旨在肯定虚拟财产的物权属性，并借鉴国外的先进经验，通过立法完善我国的虚拟财产保护体系。
[Abstract]:In recent years, the network game industry has occupied the leading position of the network industry. With the advent of the network era, people can own property in the real world, but also have "property" in the virtual network world, such as virtual equipment in online games, virtual currency and so on. The transaction of virtual property among gamers is followed, and the disputes arising therefrom are increasing day by day. How to correctly identify the legal nature of the above transaction behavior has become a hot topic in the current theoretical research. However, at present, the relevant provisions of Chinese law in the field of virtual property are blank, and the definition of virtual property on the network is also vague, which leads to the lack of legislation and the difficulty of judicial cognizance in dealing with disputes over virtual property on the network. Therefore, this paper mainly focuses on the legal protection of network virtual property from the following parts: the first part affirms the value of virtual space. This part proves the value meaning of virtual space by quoting Gaufman's theory of mimicry and Habermas' theory of communicative behavior, and points out that the standardization of network communication behavior should be strengthened as well as the rationality of network communication behavior. At the same time, it is the innovation of this paper. The second part holds that virtual goods belong to property category and have property. Firstly, the concept of virtual property is defined, and then the definition of virtual property and the necessity of protecting virtual property in the broad sense and narrow sense are introduced respectively. Then it analyzes the negation theory and positive theory of virtual property, and uses Bentham and Locke's viewpoint to prove that virtual property belongs to labor achievement, and from the value, The third part discusses the property attribute of virtual property. As the focus of this paper, the intellectual property theory, creditor's right theory and real right theory are evaluated and analyzed. By comparing the property of virtual property with that of traditional property, this paper affirms the property attribute of virtual property. Finally, this paper mainly analyzes the ownership of virtual property and the current situation of legislation. Combining with the legal protection measures of virtual property in some countries and regions, the author puts forward some suggestions on the legislation and judicial perfection of our country. The purpose of this paper is to affirm the property right attribute of virtual property, and to perfect the virtual property protection system of our country by legislation for reference from the advanced experience of foreign countries.
