商标合理使用法律制度研究

【摘要】:在经济全球化和知识产权迅速发展的今天,我们越来越注意到知识产权的重要性,商标权作为知识产权的重要组成部分也进入了人们的视线。大多数国家或国际条约中都对商标权法律作出了规定并进行了实践,许多专家、学者和行政司法人员也开始研究商标权制度的问题。在当今社会,商标权人的商标权在无限制的扩张,人们需要探讨平衡解决商标权人的私人垄断权利与社会公众的合理需求的矛盾问题,这就需要对商标权进行限制。商标合理使用制度是解决这一矛盾的重要途径。 我国商标合理使用制度尚未建立,理论上研究不足,相关法律规定较为简单,过于笼统,可操作性不强,给行政执法和司法实践带来了诸多麻烦。本文在参考国内外理论研究的基础上,结合我国《商标法》的立法宗旨,同时借鉴外国的先进法律规定和司法实践,系统论述了商标合理使用制度的概念、理论基础、具体类型和判断标准等基本理论。同时又综合运用文献研究、分析比较、实证分析等方法,结合我国商标合理使用制度的现状,对我国商标合理使用制度的构建提出了立法建议。本文分为引言、正文和结论三部分,正文又分为四个部分。 第一部分:商标合理使用制度的概述。首先对“商标合理使用”术语进行了分析,在此基础上概括商标合理使用的概念。其次论述了商标合理使用的特点与功能,商标权限制与商标合理使用的关系,商标合理使用的正当性。然后阐述了商标合理使用理论基础。最后论述了商标合理使用的判断标准。 第二部分:商标合理使用制度的具体类型。首先阐述了商标合理使用的不同分类,并对本文阐述的类型作了说明。其次论述了叙述性合理使用的概念和理论基础、构成要件和具体类型、立法规定和典型案例,对理论基础的论述引入了“第二含义”,再次论述了指示性合理使用的概念和实质、构成要件和具体类型、立法规定和典型案例,并对叙述性合理使用与指示性合理使用作了比较,然后又介绍了比较广告的概念和实质,在商标“混淆”和“淡化”理论基础上分析了比较广告与商标侵权的关系,最后阐述了滑稽模仿的概念、背景、理论基础,利用商标“混淆”和“淡化”理论分析了滑稽模仿与商标侵权的关系。 第三部分:我国商标合理使用制度的现状与存在问题。首先介绍了我国现行有关商标合理使用制度的相关法律规定,,然后对现行法律规定进行了评价或说明,在此基础上又概括说明我国商标合理使用制度存在的问题,并具体介绍表现方式。 第四部分:完善我国商标合理使用制度的立法建议。分析了我国商标合理使用制度的理论依据与现实依据,并对完善我国商标合理使用制度提出了立法建议。
[Abstract]:With the economic globalization and the rapid development of intellectual property, we pay more and more attention to the importance of intellectual property, and trademark right, as an important part of intellectual property, has also entered the line of sight. In most countries or international treaties, the law of trademark rights has been stipulated and put into practice, and many experts, scholars and administrative judicial personnel have also begun to study the system of trademark rights. In today's society, the trademark rights of the trademark owners are expanding without restriction. People need to discuss how to balance the contradiction between the private monopoly rights of the trademark owners and the reasonable needs of the public, which needs to restrict the trademark rights. The system of fair use of trademark is an important way to solve this contradiction. The system of rational use of trademark in our country has not been established, the theoretical research is not enough, the relevant laws and regulations are relatively simple, too general, and the operability is not strong, which brings a lot of trouble to the administrative law enforcement and judicial practice. On the basis of theoretical research at home and abroad, combined with the legislative purpose of Trademark Law in China, and drawing on the advanced legal provisions and judicial practice of foreign countries, this paper systematically discusses the concept and theoretical basis of the system of rational use of trademarks. Basic theories such as specific types and judgment criteria. At the same time, comprehensive use of literature research, analysis and comparison, empirical analysis and other methods, combined with the current situation of China's trademark fair use system, put forward legislative suggestions for the establishment of our country's trademark fair use system. This paper is divided into three parts: introduction, text and conclusion, and the text is divided into four parts. The first part: the outline of fair use system of trademark. First of all, the term "fair use of trademark" is analyzed, and the concept of reasonable use of trademark is summarized. Secondly, it discusses the characteristics and functions of the rational use of trademark, the relationship between the limitation of trademark right and the rational use of trademark, and the legitimacy of the rational use of trademark. Then elaborated the trademark reasonable use theory foundation. Finally, it discusses the standard of judging the rational use of trademark. The second part: the specific types of trademark fair use system. At first, the different classification of rational use of trademark is expounded, and the types described in this paper are explained. Secondly, it discusses the concept and theoretical basis of rational use of narrative, the constitutive elements and specific types, legislative provisions and typical cases, and introduces "the second meaning" to the discussion of theoretical basis. Then it discusses the concept and essence of indicative rational use, its constitutive elements and specific types, legislative provisions and typical cases, and makes a comparison between narrative rational use and indicative rational use. Then it introduces the concept and essence of comparative advertising, analyzes the relationship between comparative advertising and trademark infringement on the basis of the theory of "confusion" and "desalination" of trademarks, and finally expounds the concept, background and theoretical basis of antics. This paper analyzes the relationship between antics and trademark infringement by using the theory of "confusion" and "desalination". The third part: the current situation and existing problems of the fair use system of trademark in our country. This paper first introduces the relevant laws and regulations on the fair use of trademarks in our country, and then evaluates or explains the current legal provisions, and on this basis, it also summarizes the problems existing in the system of fair use of trademarks in our country. And the specific presentation of the way. The fourth part: perfect our country trademark reasonable use system legislation suggestion. This paper analyzes the theoretical and practical basis of the fair use of trademarks in China, and puts forward some legislative suggestions for perfecting the system of rational use of trademarks in China.
