广东省中药复方专利的现状分析及保护与发展策略研究

【摘要】：目的：本研究的总体目标是在研究中药复方专利制度的基础上,依托专利信息资源,运用统计学聚类分析和回归分析的方法,重点针对广东省2004—2013年中药复方专利数据进行分析,了解中药复方药品专利整体发展水平和广东省该领域的整体情况和存在问题。针对当前存在的问题从政府、市场、企业等方面对广东省中药复方专利药品的研发与保护进行发展策略研究。方法：1.文献研究法。基于万方数据平台、维普中文科技期刊数据库、PUBMED英文文献数据库、Science Direct数据库和SLCC西文期刊数据库以及相关书籍报刊,通过研究近十多年关于中药复方专利保护、中药复方研究、专利信息利用、中医药知识产权保护、医药专利制度研究等多方面的文献,以了解国内外有关中医药专利保护、中药复方研发、专利申报与保护的理论知识、研究发展及最新趋势,找出存在于我省中药复方专利保护和发展过程中的具体问题。2.访问广东省知识产权局、广州中医药大学经管学院和广东省知识产权研究与发展中心有关专家,就专利数据库的建立、专利统计学指标的选取、专利统计学分析、中药复方知识产权侵权判定、知识产权发展策略研究及论文写作过程中出现的问题等方面做定期的请教与探讨,并做好归纳总结。3.专利检索法及专利地图法。本研究广东省战略新型专利平台(大为Patent)、中国专利信息中心专利平台、国家知识产权局专利平台、SOOPAT专利数据库、CNIPR中外专利平台。对符合条件的中药复方专利信息分析汇总,选用相关专利指标,从中挖掘有效信息,从发展趋势、地域分布、发明人分析、有效时间影响因素等几点进行探索性分析,把握该领域的总体情形和趋势。4.统计分析法。本研究主要选用spss19.0和exce12007为统计软件,在广东省十年间中药复方专利发展趋势、地域分布、专利功效分布及专利维持时间影响因素方面进行了K-mean值聚类分析、二元Logistic回归分析及线性回归分析。结果：数据挖掘处理后,得出如下结果：1.省内十年间总体保持上升态势,但省内区域间状态相差悬殊。2.从申请人来看,高校和个人申请量较多,但专利维持量水平不高。3.授权专利维持时间不高申请人类型、专利权是否转移、是否有专利代理公司、从属权利要求数量、是否提供实验数据、申请书页数和是否开创新剂型依次为主要原因。4.未获授权专利占半数以上,未缴年费、公布后视为撤回和公布后驳回分列无效原因前三位。结论：广东省在该领域保护与发展主要需改善的地方有：1.完善中药复方专利制度。2.增强科研成果的转化水平。3.专利质量有待提升。4.企业的复方研发能力有待加强。5.区域间交流合作有待加强。6.政府要加大扶持力度和引导正确舆论导向。针对上述问题,从政府法制与政策更加健全完善、企业提高研发能力与专利信息利用能力、产学研联盟和区域间交流合作以及知识产权平台构建与复合型人才培养等方面提出了建议策略。

The non-authorized patent accounts for more than half of the total, and the total unpaid annual fee is deemed to be withdrawn and published after the publication, and the first three of the reasons for the invalid are dismissed. Conclusion: Guangdong's protection and development in this area mainly need to be improved:1. Improve that compound patent system of traditional Chinese medicine. The level of transformation of scientific research results is enhanced. The quality of the patent is to be upgraded. The compound R & D capability of the enterprise is to be strengthened. The interregional exchange of information has to be strengthened.6. The government should strengthen the support and guide the correct public opinion. In the light of the above-mentioned problems, the author puts forward the proposed strategy from the aspects of the improvement of the government's legal system and the policy, the improvement of the R & D capability of the enterprise, the ability of the patent information utilization, the industry-university-research alliance and the interregional exchange cooperation, and the construction of the intellectual property platform and the compound personnel training.
