浅议在网络中的知识产权问题

【摘要】：知识产权是一种无形产权,它是指智力创造性劳动取得的成果,并且是由智力劳动者对其成果依法享有的一种权利。知识产权,在我国民法中的定义为,智力成果的创造人依法所享有的权利和生产经营活动中标记所有人依法所享有的权利的总称,包括著作权和工业产权。这里的工业产权是指商标权和专利权。但是,由于当初在在制定和实施我国的《知识产权法》的时候,还没有考虑到网络侵权这一种形式,因此,在我国的法律体系中对网络知识产权尚无专门立法。也许有些人认为网络本身就是资源共享的,而且是开放型的状态,其可供进入的端口很多,只要愿意谁都可以在网上发表言论或从网上copy下那些根本不知道属的是真名还是假名的文章。但是,须知网络只是信息资源载体的一种形式,其本质与报纸等传统媒体没有任何区别。网络经济也同现实中的经济规律是一样的,同样要遵守共同的游戏规则,这其中就包括对网上的资源的利用问题。否则,无论对谁都是不公平的,因为,任何有价值的创造都应当获得其相应的报酬。
[Abstract]:Intellectual property right is a kind of intangible property right, which refers to the achievements of intellectual creative labor and a right enjoyed by intellectual labourers in accordance with the law. Intellectual property rights, defined in the civil law of our country, are the rights enjoyed by the creators of intellectual achievements according to law and the rights of owners marked by law in production and business activities, including copyright and industrial property rights. The industrial property right here refers to the trademark right and patent right. However, since the form of network infringement has not been taken into account in the formulation and implementation of the intellectual property Law of our country at the beginning, there is no special legislation on network intellectual property rights in the legal system of our country at the time of making and implementing the intellectual property Law of our country. Perhaps some people think that the network itself is resource-shared and open, and that there are many ports to enter. Anyone who wants to post online or copy articles that don't know if they belong to a real name or a pseudonym. However, the network is only a form of information resource carrier, and its essence is no different from the traditional media such as newspaper. The network economy is also the same as the real economic law, also must abide by the common rules of the game, which includes the use of resources on the Internet. Otherwise, it is unfair to anyone, for any valuable creation should be rewarded accordingly.
