我国电影作品版权质押法律问题研究

【摘要】:电影产业取得快速发展的关键是突破资金瓶颈,但由于电影企业大多是轻资产型公司,生产设备、厂房等固定资产较少,主要是以知识产权和品牌价值等无形资产作为资产存在的表现形式,因此获得贷款融资的难度较大。新兴的版权质押担保贷款方式为电影创作融资难问题开辟了一条新的道路。贷款融资成本远低于电影产业现有的其他融资方式,并从客观上保护了电影版权的独立性,使企业能够获得持续发展的动力。在我国电影产业的融资需求日益迫切的今天,电影作品版权质押作为重要的融资担保方式,理应受到广泛的关注。然而,我国目前及于电影作品版权质押的特色理论研究,却显得较为匮乏,对国外相关经验的介绍也十分有限。此种情形下,本文认为,对电影作品的版权质押进行系统研究,则显得十分必要。 本文第一部分,围绕电影作品版权质押的理论,对电影作品及其版权内容进行了阐述,对电影作品版权质押的概念及特殊性进行了研究,从现有立法角度,对电影作品版权质押的法律依据进行了分析。 本文第二部分,将电影作品版权质押这种担保融资模式与传统电影融资模式进行了对比,指出以电影作品版权质押进行融资担保的必要性,同时介绍了目前我国电影作品版权质押的模式,并对其特点进行了客观评析。 本文第三部分,通过介绍我国电影作品版权质押的发展历程,研究了我国电影作品版权质押所面临的困境,并对其困境产生的原因进行了深入分析。 本文第四部分,在综合分析我国电影作品版权质押所面临的各个困境的基础上,通过对美国电影作品发行预售融资模式进行评析,指出其对我国的借鉴意义。同时,又从相关法律规范、抑制电影作品版权质押风险来源、完善风险分散机制的角度,提出了完善电影作品版权质押相关制度的建议。
[Abstract]:The key to the rapid development of the film industry is to break through the bottleneck of funds, but because most of the film enterprises are light asset companies, production equipment, factory buildings and other fixed assets are relatively small. It is mainly based on intangible assets such as intellectual property rights and brand value as the manifestation of assets, so it is difficult to obtain loan financing. The new way of copyright pledge guarantee loan has opened up a new way for the financing of film creation. The cost of loan financing is much lower than that of other financing methods in the film industry, and objectively protects the independence of film copyright, so that enterprises can obtain the motive force of sustainable development. Nowadays, the financing demand of film industry in our country is becoming more and more urgent. As an important way of financing guarantee, copyright pledge of film works should be paid more and more attention. However, at present, the theoretical research on the characteristics of copyright pledge of film works in our country is relatively scarce, and the introduction of relevant experience abroad is also very limited. In this case, this paper holds that it is very necessary to systematically study the copyright pledge of film works. In the first part of this paper, focusing on the theory of copyright pledge of film works, this paper expounds the film works and their copyright content, studies the concept and particularity of copyright pledge of film works, and studies the concept and particularity of copyright pledge of film works from the angle of existing legislation. This paper analyzes the legal basis of copyright pledge of film works. In the second part of this paper, the guarantee financing mode of copyright pledge of film works is compared with the traditional film financing mode, and the necessity of financing guarantee by copyright pledge of film works is pointed out. At the same time, this paper introduces the current mode of copyright pledge of film works in China, and objectively comments on its characteristics. In the third part of this paper, by introducing the development course of copyright pledge of film works in our country, this paper studies the predicament faced by copyright pledge of film works in our country, and makes a deep analysis of the causes of its predicament. In the fourth part of this paper, based on the comprehensive analysis of the difficulties faced by the copyright pledge of film works in our country, this paper analyzes the financing mode of the distribution and pre-sale of American film works, and points out its reference significance to our country. At the same time, from the point of view of relevant legal norms, restraining the source of copyright pledge risk of film works and perfecting the risk dispersion mechanism, this paper puts forward some suggestions on perfecting the related system of copyright pledge of film works.
