云计算环境下软件知识产权保护研究

【摘要】：自计算机软件产生到现在软件已然成为规模化产业，软件知识产权保护问题一直是各国法律界和司法实践界讨论的热点。从上个世纪八十年代起，在美国的大力推动下，软件著作权法保护模式成为了主流。但是，反对的声音从未消失过。 随着技术的发展，著作权保护模式的缺陷日益凸显。各国开始寻求探索软件专利保护方式。在一些国家地区，己经开始对软件授予专利，实施专利保护。近年来，新兴起的云计算技术服务对软件传播模式等产生了重大影响，现行的软件著作权保护模式也受到了巨大的挑战。 本文从软件和云计算技术基本概念和特点着手，分析了在云计算Saas模式对软件知识产权保护影响以及传统保护方式的局限。重点介绍了美国、日本和欧洲软件专利保护的发展历程和对新技术的应对方式。通过分析现行争议的几种软件保护模式，探究各自的优缺点，并借鉴国外经验，结合新技术Saas模式的特点及其环境下软件传播的特点，，笔者提出懫用以专利保护核心，商业秘密保护相辅助的知识产权保护解决方案。并介绍了我国软件知识产权保护现状，结合前述分析，最后针对我国软件知识产权保护提出了笔者的完善建议。

The paper introduces the development of software patent protection in the United States, Japan and Europe, and the application of new technology to the new technology. In this paper, through the analysis of several software protection modes in the current dispute, the advantages and disadvantages of the present dispute are explored, and the characteristics of the new technology Saas mode and the characteristics of the software communication in the environment are discussed.
