民法视野下的个人信息权研究

【摘要】：随着计算机和网络技术的发展,个人信息的重要性越来越凸显出来。个人信息不仅关系到信息资源的利用与共享,更关系到信息主体的人格尊严。与此同时,个人信息也遭到了全面的侵害,不仅商业机构和个人还有政府等公共管理部门,都或多或少地参与或实施了非法收集、存储、处理、传输和使用个人信息的行为,互联网更是成为了我国个人信息违法收集和滥用的重灾区。鉴于个人信息对信息主体的重要意义,以法律形式确立一项新型的具体人格权——个人信息权,以维护人的权利和尊严具有必要性和合理性。本文从民法的角度对个人信息权的相关问题进行探讨和研究。文章主要从三个方面来阐述观点的：首先,文章论述了设立个人信息权的理论基础,论证了设立个人信息权的必要性和选择民法人格权模式保护个人信息的合理性。其次,文章阐述了个人信息权的性质、客体、内容和民事责任。个人信息权是一项新型的具体人格权；个人信息权的客体,即个人信息,具有相关性和可识别性；个人信息权的内容包括消极权能和积极权能；侵犯个人信息权应该承担相应的民事责任。最后,文章指出我国民法保护个人信息权具有局限性并提出了相关立法建议。
[Abstract]:With the development of computer and network technology, the importance of personal information is becoming more and more prominent. Personal information is not only related to the use and sharing of information resources, but also to the personal dignity of the information subject. At the same time, personal information has also been a comprehensive violation, not only businesses and individuals and the government public administration and other departments, are more or less involved in the implementation or illegal collection, storage, processing, transmission and use of personal information, the Internet is becoming our personal information collection and illegal abuse of the disaster area. In view of the importance of personal information to the subject of information, it is necessary and reasonable to establish a new specific personality right, personal information right, in order to safeguard human rights and dignity. This paper discusses and studies the related issues of the right of personal information from the perspective of civil law.
