江苏海事江海一体化监管机制研究

【摘要】：本文主要是运用公共管理理论关于建设公共服务型政府的理论与方法,来审视江苏海事局推行的江海一体化海事管理机制的现状,分析现状与公共管理理论体系的符合情况；分析未来江海一体化海事管理机制的发展方向,提出相关路径建议。通过研究,本文指出了在江苏海事局推进实施江海一体化海事管理机制过程中还存在主要问题：一是由于管理习惯、思维定势,在实践过程中不自觉地沿袭既有做法；或受限于单位的实际情况,在一定程度上偏离了执法模式改革原则性要求,造成了现有监管机制的不完善；二是在江海海事管理一体化过程中,虽然管理人和管理对象存在着相对的统一,但不可否认的是江和海在许多方面存在很大的差异,这就在一定程度上限制了现行海事管理机制的有效实施；三是海上和内河执法依据的不统一,造成了江苏辖区范围执法标准的差异,在一定程度上造成了行政相对人的困扰和不解；四是沿江沿海港口发展的不平衡性带来沿江沿海监管手段的不平衡,江海之间尚不能实现海事管理资源共享,海事管理效率不高,成本较大。本文立足于公共管理建立服务型政府的视野下,提出了推动江海一体化海事管理机制实施方案：根据江苏海事局管辖水域江海交汇的实际特点,针对沿江沿海海事管理机制的异同点,按照统一管理、精简效能、整合协调、分级分类、突出现场、适应发展等原则,进一步理顺管理关系、明确事权主体、整合海事管理资源、提高管理效率,统筹沿江与沿海海事管理,从推动管理机制一体化、资源配置一体化、执法依据一体化、发展规划一体化、服务机制一体化、巡航机制一体化、救助机制一体化、人才保障一体化等八个方面提出了完善江苏海事局江海一体化海事管理机制的建议,打造具有江苏特色的海事管理机制,进一步提高海事管理效能,更好地提供优质的海事公共服务,推进江苏海事局建设国际一流水平的海事强局。
[Abstract]:This paper mainly uses the theory and method of public management theory on the construction of public service-oriented government to examine the current situation of the integrated maritime management mechanism implemented by Jiangsu Maritime Bureau. Analysis of the current situation and the theoretical system of public management in line with the situation; This paper analyzes the development direction of the future integrated maritime management mechanism of rivers and seas, and puts forward some suggestions on the relevant paths. Through the research, this paper points out the main problems in the process of implementing the integrated maritime management mechanism in Jiangsu Maritime Bureau: first, because of the management habits, thinking fixed. In the process of practice, we unconsciously follow the existing practice; Or limited by the actual situation of the unit, to a certain extent deviate from the law enforcement model reform principle requirements, resulting in the existing regulatory mechanism is not perfect; Second, in the process of maritime management integration, although there is a relative unity between managers and management objects, it is undeniable that there are great differences between Jiang and Hai in many aspects. This limits the effective implementation of the current maritime management mechanism to a certain extent; Thirdly, the disunity of the law enforcement basis between the sea and the inland river caused the difference of the law enforcement standards in Jiangsu jurisdiction, and to some extent caused the perplexity and puzzlement of the administrative counterpart; Fourthly, the unbalanced development of the coastal ports along the Yangtze River leads to the imbalance of the means of supervision along the river, the maritime management resources can not be shared between rivers and seas, the efficiency of maritime management is not high, and the cost is high. Based on the view of establishing a service-oriented government by public management, this paper puts forward a scheme to promote the integrated maritime management mechanism of rivers and seas: according to the actual characteristics of the intersection of rivers and seas in the waters under the jurisdiction of Jiangsu Maritime Administration. In view of the similarities and differences of coastal maritime management mechanism along the Yangtze River, in accordance with the principles of unified management, streamlined efficiency, integration and coordination, grading and classification, giving prominence to the scene, adapting to development, further straighten out the management relationship and clarify the subject of power. Integrate maritime management resources, improve management efficiency, coordinate maritime management along the river and coastal areas, promote the integration of management mechanism, resource allocation, law enforcement basis integration, development planning integration. Eight aspects, such as service mechanism integration, cruise mechanism integration, rescue mechanism integration, talent support integration and so on, are put forward to improve the integrated maritime management mechanism of Jiangsu Maritime Bureau. To build the maritime management mechanism with Jiangsu characteristics, to further improve the efficiency of maritime management, to provide better quality maritime public services, and to promote Jiangsu Maritime Bureau to build a strong maritime bureau of international first-class level.
