提高食品行业协会参与食品安全治理能力的对策研究

【摘要】:目前我国各种食品安全事件不断发生,如“地沟油”、“剧毒农药姜”、“苏丹红”等,食品安全事件涉及人员多,影响范围广,危害大。因此,政府作为公共管理的主体,出台了相关政策和法律加强食品安全监管,但受制于诸多因素,政府单边治理下的效果并不是太理想。因此,寻找第三方力量来协助政府治理食品安全问题已成必然。食品行业协会近年来发展迅速,组织数量逐渐增多,辐射范围越来越广。同时食品行业协会的专业化、低成本、高效率的运作优势恰是对政府强制性、高成本、低效率的有力补充。本文在文献梳理的基础上,介绍了食品行业协会、食品安全治理等相关概念及理论,分析了我国食品行业协会对食品行业健康发展产生的积极作用,包括:提高政府对食品安全的监管效能,维护食品行业稳定发展。同时,深入分析食品安全治理中我国食品行业协会治理能力存在的问题,具体表现为:自治权力不足、政府对食品行业协会放权不够、食品行业协会自身能力建设不足及缺乏对食品行业协会进行监督等,并对产生这些问题的原因进行了深入的分析。借鉴了美国和荷兰食品行业协会在治理能力方面的成功做法,进而提出了相应的对策,即建立健全食品行业协会的法律法规,建立政府与食品行业协会互动合作的模式,提高食品行业协会的自身能力建设以及建立专门的部门对食品行业协会进行监督。
[Abstract]:At present, various kinds of food safety incidents occur continuously in our country, such as "gutter oil", "highly toxic pesticide ginger", "Sudan red" and so on. Food safety incidents involve many personnel, have a wide range of influence and are harmful. Therefore, as the main body of public administration, the government is the main body of public administration. Relevant policies and laws have been issued to strengthen food safety supervision, but the effect under unilateral government governance is not very satisfactory because of many factors. It has become inevitable to look for third party forces to help the government deal with food safety problems. Food industry associations have developed rapidly in recent years, the number of organizations has gradually increased, and the scope of radiation has become wider and wider. At the same time, the specialization and low cost of food industry associations, The operational advantage of high efficiency is a powerful supplement to the government's mandatory, high cost and low efficiency. Based on the literature review, this paper introduces some related concepts and theories, such as food industry association, food safety governance and so on. This paper analyzes the positive effects of the food industry association on the healthy development of the food industry, including: improving the efficiency of the government's supervision over food safety, maintaining the stable development of the food industry, at the same time, This paper deeply analyzes the problems existing in the governance ability of food industry associations in China, which are manifested in the following aspects: insufficient autonomy, insufficient government delegation of power to food industry associations, The insufficient capacity-building of food industry associations and the lack of supervision of food industry associations, etc., and the in-depth analysis of the causes of these problems. It draws on the successful practices of the United States and the Dutch food industry associations in terms of governance capacity. Then the corresponding countermeasures are put forward, that is, establishing and perfecting the laws and regulations of the food industry association and establishing the mode of the interactive cooperation between the government and the food industry association. Improve the capacity of food industry associations and establish special departments to supervise food industry associations.
