我国政府职能转变下的公共行政民营化研究

【摘要】:随着公共行政事务日益繁多和复杂化,传统的行政管理模式和机制在面对行政事务繁多和公众对政府的期待和要求越来越高时就显得反应迟缓,无法提供多样化、高标准、高质量公共服务,从而推动了公共行政民营化改革在全球范围内兴起。公共行政民营化改革契合了法治政府的创新社会管理的理念,也是行政体制改革、转变政府职能,建设服务型政府的题中应有之义。在公共行政改革中,民营化作为一种改革的方式,也是政府治理的一种新的理念,打破政府垄断公共行政事务的局面,更多更好依靠企业、社会组织等非政府机构履行公共行政职能,满足社会公众对公共服务更多的期待,更好提供公共服务,提升公共服务的质量。本文梳理了各种文献资料,在综合和总结国内外关于公共行政民营化研究成果的基础上阐述在我国政府职能转变条件下如何有效推进公共行政民营化改革。 对公共行政民营化改革进行研究需要对公共行政民营化进行总体把握,了解公共行政民营化在全球范围内兴起的背景,通过诠释公共行政和民营化的含义,明晰公共行政民营化的概念。叙述了作为公共行政民营化的理论基础公共选择理论、治理理论、新公共管理理论的内容。通过公共行政民营化的现状的分析,对公共行政民营化依据不同的标准进行分类,具体阐述公共行政民营化的实施方式。介绍英美国家公共行政民营化改革的实践,总结其改革的特点和成功之处,并梳理我国公共行政民营化的实践,明晰改革的范围领域和存在的问题。 公共行政民营化的改革方式之所以被各国采用因其具有一定的积极意义,如拓宽公共服务的渠道、提高行政效能、转变政府管理模式等诸多意义,同时公共行政民营化改革也出现了许多问题,如依据的规范性文件位介较低、界限不清晰、责任不明确等。针对上文叙述的我国公共行政民营化存在的问题,从法律调整的角度来论述我国公共行政民营化改革需要在那些方面进行调整、规范、规制。确定公共行政民营化的范围,不可单一采用罗列的方式去划定范围,应该采用禁止和限定的方式来明晰范围,通过对涉及国家核心功能、公共安全、公民基本权利和自由等事项进行圈定明确公共行政民营化改革领域的禁区,同时对法律允许的公用行政领域哪些公共产品和服务能够采用民营化的方式提供进行概括性的划定。完善公共行政民营化的法律程序,只有通过设定的公正的程序,才能选择出实力雄厚、工作效率高、提供的服务质量好的私营部门来承担公共行政事务的任务。公正的法律程序关系到公共行政民营化改革能否顺利推进,公共利益是否能够得到保障。政府的监督规制是保障公共行政民营化改革成功的关键一步,通过设定相对独立的监督主体、创新监督方式、完善绩效监督考核机制、强化政府在民营化中的监督责任,确保提供公共服务的私营部门更好的履行其职责,为社会公众提供高质量的服务,实现公共行政民营化改革的既定目标。
[Abstract]:With the increasing diversity and complexity of the public administration affairs, the traditional administrative mode and mechanism appear to be slow in response to a wide range of administrative affairs and the public's expectations and demands for the government, which can not provide diversification, high standards and high quality public services, thus promoting the global reform of the privatization of public administration in the global scope. The reform of the privatization of public administration coincides with the idea of the innovation of social management by the rule of law, the reform of the administrative system, the transformation of the functions of the government and the construction of a service-oriented government. In the reform of public administration, the privatization as a way of reform is a new concept of government governance, and it breaks the government monopoly public. The situation of administrative affairs is more and better to rely on the non-governmental organizations such as enterprises, social organizations and other non-governmental organizations to fulfill the public administrative functions, meet the public's expectation of public service, provide better public services and improve the quality of public services. This paper has combed various documents and summarized the research on the privatization of public administration at home and abroad. Based on the achievements, this paper expounds how to effectively push forward the privatization of public administration under the transformation of government functions.
The study of privatization of public administration needs to have a general grasp of the privatization of public administration, to understand the background of the rise of the privatization of public administration in the world, and to clarify the concept of privatization of public administration through the interpretation of the meaning of public administration and privatization, and to describe the public choice of the theoretical basis for the privatization of public administration. The content of theory, governance theory and new public management theory. Through the analysis of the present situation of the privatization of public administration, this paper classifies the privatization of public administration according to the different standards, expounds the implementation mode of the privatization of public administration, introduces the practice of the privatization reform of public administration in the Anglo American countries, and summarizes the characteristics and success of the reform. And comb the practice of privatization of public administration in China, clarify the scope and problems of reform.
The reform mode of the privatization of public administration has been adopted by various countries for its positive significance, such as broadening the channels of public service, improving the administrative efficiency and changing the government management mode. Meanwhile, there have been many problems in the reform of the privatization of public administration, such as the low standard of the standard documents and the unclear boundaries. In view of the problems existing in the privatization of public administration described above in our country, it is necessary to adjust, standardize and regulate the privatization of public administration in our country from the angle of legal adjustment. The scope of privatization of public administration should be determined, and the scope of the privatization of public administration should not be defined by a single way, and the prohibition should be adopted. To clarify the scope and define the forbidden areas in the field of privatization of public administration through the matters involving the core functions of the state, public security, the basic rights and freedoms of the citizens, and to provide a summary of which public products and services can be privatized in the field of public administration that are permitted by law. In order to improve the legal procedure of the privatization of public administration, only by setting a fair procedure can we choose the task of the private sector with strong strength, high work efficiency and good service quality to undertake the task of public administration. The fair legal procedure is related to the smooth promotion of the privatization reform of the public administration and the public interest. The government supervision and regulation is the key step to ensure the success of the reform of the privatization of public administration. By setting a relatively independent supervision body, innovating the supervision mode, improving the performance supervision and assessment mechanism, strengthening the government's supervision responsibility in privatization, and ensuring the private sector providing public service to better perform it Responsibilities, providing high quality services for the public, and achieving the established goal of privatization of public administration.
