海关公务员责任体系完善研究

【摘要】:海关是国家的进出关境监督管理机关,担负着保障国家经济、政治安全和稳定的职责,海关公务员责任体系建设直接关系到海关有效监管、高效运作的能力。当前,我国以法律法规形式设计了行政执法责任制和党风廉政建设责任制等责任制度,与海关行政执法、纪检监察和干部人事管理等工作机制共同构成海关公务员责任体系。当前,海关公务员责任体系还存在诸多问题,具体体现在各项责任制度设计相互交叉重叠,对于海关公务员的责任设定、责任行使、责任评价和追究缺乏顶层设计,导致海关公务员履行职责时监督制约乏力,出现执法腐败、执法差错等问题后责任追究难以落实到位。因此,完善海关公务员责任体系成为建设责任型海关的必然途径。 海关公务员责任体系的研究涉及公共管理学、行政法学和人力资源管理学等多个学科,本文作为公共管理专业硕士学位论文,侧重于具体问题的挖掘、分析和解决。本文的研究在阅读大量国内外关于责任政府、政府责任体系、行政问责等文献的基础上,通过实地考察掌握海关公务员责任体系建设的丰富原始素材,以质性研究为主。对于海关公务员责任体系的构建,本文提出将有关于海关公务员责任的一系列制度、机制视为一个完整的系统,包括组织人事制度、执法监督制度和考核激励机制的观点,并对责任体系逐步趋向健全的发展和主要问题展开了论述。最后,本文在对海关公务员责任体系结构分析和问题剖析的基础上提出从责任设定、职责履行、考核评价和激励追究各个层面予以完善的对策,主要包括建立海关公务员分类制度、海关组织由科层制向扁平化转变、完善权力监督制约和建立责任导向的海关执法考核评价制度等具体措施。对于实现海关职能转变、构建责任海关具有一定的应用价值。
[Abstract]:Customs is the supervision and administration organ of the national entry and exit border, which is responsible for ensuring the national economy, political security and stability. The construction of the civil service responsibility system of customs is directly related to the ability of effective supervision and efficient operation of customs. At present, in the form of laws and regulations, China has designed the responsibility system of administrative law enforcement responsibility system and party style and clean government construction responsibility system, which, together with the working mechanism of customs administration law enforcement, discipline inspection and supervision and cadre personnel management, constitutes the duty system of customs civil servants. At present, there are still many problems in the responsibility system of customs civil servants, which are embodied in the overlapping design of each responsibility system, the lack of top-level design for the duty setting, responsibility exercise, responsibility evaluation and accountability of customs civil servants. As a result, the supervision and restriction of customs civil servants are weak, the problems of law enforcement corruption, law enforcement errors and so on are difficult to be carried out. Therefore, perfecting the duty system of customs civil servants becomes an inevitable way to build responsible customs. The research of civil servant responsibility system of customs involves many subjects, such as public management, administrative law and human resource management. As a master's degree thesis of public management, this paper focuses on the excavation, analysis and solution of specific problems. On the basis of reading a large number of domestic and foreign documents on responsible government, government responsibility system, administrative accountability and so on, this study grasps the rich raw materials of the construction of civil service responsibility system of customs through on-the-spot investigation, focusing on qualitative research. For the construction of the civil service responsibility system of customs, this paper puts forward the viewpoint that there are a series of systems concerning the responsibility of customs civil servants, and the mechanism is regarded as a complete system, including the organizational and personnel system, the supervision system of law enforcement and the examination and encouragement mechanism. At the same time, the development and main problems of responsibility system are discussed. Finally, on the basis of analyzing the structure and problems of the civil servants' responsibility system, this paper puts forward some countermeasures to perfect the system from the aspects of responsibility setting, duty fulfillment, evaluation and incentive. It mainly includes the establishment of the classification system of customs civil servants, the transformation of customs organization from hierarchy to flattening, the improvement of power supervision and restriction, and the establishment of a duty oriented assessment system for customs law enforcement and other concrete measures. It has certain application value for realizing the transformation of customs function and constructing responsible customs.
