垃圾短信及其治理分析

【摘要】:摘要:随着移动通信业务的飞速发展,手机终端的深度普及,手机短信业务已经成为日常生活必不可少的一部分。手机短信在给公众带来便利的同时,伴随而生的垃圾短信却给公众带来了诸多烦恼,不仅影响了人们的日常生活扰乱了社会的通信和市场秩序,还会给社会风气带来不良影响。因此,如何治理垃圾短信已经成为一个重要的社会问题,在现有的治理方式下,如何结合公共管理学的相关理论推进治理成效已经成为一个重要的实践课题。 本文综合运用了公共治理理论、公共管理伦理学理论、法学相关理论和观点,结合日常工作的实践经验,采用实证分析和综合研究方法,在综述国内外有关垃圾短信治理研究现状的基础上,通过阐述从定义、分类、特征等角度对垃圾短信进行描述,先初步探讨了垃圾短信的特征对其进行了综合的定义。然后通过对国外先进经验的总结以及垃圾短信治理工作的现状分析,提出了垃圾短信泛滥的成因:国家立法不够完善、个人信息的保护不重视、运营商的职业伦理规范不够、政府治理力度不够。针对以上问题,提出了完善短信业务立法、优化企业内部管理、手机用户自律以及加强宣传构建良好短信文化四项治理对策。
[Abstract]:Absrtact: with the rapid development of mobile communication service and the popularity of mobile terminal, SMS service has become an indispensable part of daily life. While SMS brings convenience to the public, it brings many troubles to the public. It not only affects people's daily life and disturbs the social communication and market order, but also brings bad influence to the social atmosphere. Therefore, how to deal with spam messages has become an important social problem, under the existing governance, How to combine the relevant theories of public management to promote the effectiveness of governance has become an important practical issue. This paper synthetically applies the theory of public governance, the theory of ethics of public management, the theory and viewpoint of law. Based on the practical experience of daily work, using empirical analysis and comprehensive research methods, on the basis of summarizing the current situation of research on the governance of spam short message at home and abroad, this paper describes the spam short message from the perspectives of definition, classification, characteristics, and so on. First, the characteristics of spam SMS are discussed. Then through the summary of foreign advanced experience and the analysis of the current situation of spam SMS management, the causes of spam SMS flooding are put forward: the national legislation is not perfect, the protection of personal information is not taken seriously, and the professional ethics norms of operators are not enough. Government governance is not strong enough. In view of the above problems, this paper puts forward four countermeasures: perfecting the legislation of short message service, optimizing the internal management of the enterprise, self-discipline of mobile phone users and strengthening propaganda and constructing a good short message culture.
