优化地方专利资助政策提高专利质量策略的研究

【摘要】：专利资助政策是专利管理体制中的重要组成内容,直接影响到专利资助的效果及公共财政资源的合理配置。专利质量对中国创新和国际竞争力的提高起决定性的作用,目前中国企业在参与国际竞争中因技术创新不足的而导致的劣势地位未出现明显的改善。本课题研究地方政府制订、实施的专利资助体系,并以提高专利质量为目标提出优化政策的建议。首先,详细阐述专利质量影响因素,围绕专利从发明创造、专利申请、专利审查、专利维持全过程,构建符合中国现状影响因素理论模型。详细分析各个阶段我国影响专利质量的特点和作用情况,通过分析找出现阶段政策可控的、可操作的重点环节主要是专利申请动机的引导、费用补贴、代理水平等。其次,比较各地方的专利资助政策种类及效果。系统梳理分析了29个省的专利资助政策。从各地专利资助办法的政策导向、资助对象等七个方面进行比较研究,分析其中存在的问题。分析结果表明有明确政策导向、按比例而非全额资助给予引导和扶持、限定最高额度、明确监管的资助模式对提高专利质量及促进创新发展更为有效。再次,分析区域的专利质量测度指标主要包含专利申请质量、对国外专利申请量、专利维持时间三个方面,综合衡量影响专利质量的各项因素,以天津市2009年至2014年六年的专利相关统计数据及资助数据为基础进行了专利质量对专利资助政策的敏感度分析和弹性分析研究。结果表明天津市专利质量与专利资助额呈正相关关系,专利质量对专利资助的敏感度逐步上升,专利资助政策对专利质量提升确实发挥着越来越大的作用。根据上述研究的结论从政策导向、资助额度、办理规程、资助范围、资助对象、资助条件、资金的管理和监督方面,提出解决问题的基本思路,最终形成具有建设性的对策建议。
[Abstract]:Patent subsidy policy is an important part of patent management system, which directly affects the effect of patent subsidy and the rational allocation of public financial resources. Patent quality plays a decisive role in the improvement of China's innovation and international competitiveness. At present, the inferior position of Chinese enterprises in participating in international competition due to the lack of technological innovation has not been significantly improved. This paper studies the patent subsidy system formulated and implemented by the local government, and puts forward some suggestions for optimizing the patent quality in order to improve the quality of the patent. Firstly, the influencing factors of patent quality are expounded in detail. The theoretical model of influencing factors in accordance with the present situation of China is built around the whole process of patent creation, patent application, patent examination and patent maintenance. The characteristics and functions of affecting patent quality in China at each stage are analyzed in detail. Through the analysis of the controllable policy in the emergence stage, the key links of operation are mainly the guidance of patent application motivation, the subsidy of expenses, the level of agency and so on. Secondly, compare the types and effects of patent subsidy policies in different places. The patent subsidy policies of 29 provinces are analyzed systematically. This paper makes a comparative study from seven aspects, such as the policy direction of patent subsidy method, the object of subsidy and so on, and analyzes the existing problems. The results show that it is more effective to improve the quality of patents and promote the development of innovation by giving guidance and support in proportion rather than full-scale funding, limiting the maximum amount, and clearly regulating the mode of financial support to improve the quality of patents and promote the development of innovation. Thirdly, the evaluation index of regional patent quality mainly includes the quality of patent application, the quantity of patent application abroad, the duration of patent maintenance, and comprehensively measures the factors that affect the quality of patent. Based on the patent statistics and subsidy data from 2009 to 2014 in Tianjin, the sensitivity analysis and elasticity analysis of patent quality to patent subsidy policy were carried out. The results show that there is a positive correlation between the patent quality and the amount of patent aid in Tianjin. The sensitivity of patent quality to patent aid is gradually increasing. The patent subsidy policy really plays a more and more important role in the improvement of patent quality. According to the conclusions of the above-mentioned research, the basic ideas for solving the problems are put forward from the aspects of policy orientation, amount of funding, procedures for handling, scope, target, conditions, management and supervision of funds. Finally form constructive countermeasures and suggestions.
