论决策失误的根源、边际与非难——兼论决策过失责任

【摘要】：目标确立错误和实现目标的方式或方法选择错误,就会造成决策失误。其根源在于危险源增多并演变为事故隐患,社会组织变革使一些决策者的角色调整不适应,行政决策行为难以形成有力的制度规范约束,能力素质出现不应有的缺失,都可能造成决策失误。决策失误区分为无责性失误和行政决策失误。无责性失误是指决策者基于对某种政治追求或科学理想所作出的探索性决策,因历史认识的局限性而产生的难以避免的失败且不应非难的情形。对于行政决策失误,则应当依据决策客体的重要性、决策知识的不完备性、危害后果的严重性等方面综合考虑,认定决策失误责任程度和性质。责任的实现形式是问责、纪律责任、行政责任和刑事责任中的决策过失责任。
[Abstract]:Mistakes in setting goals and in choosing ways or methods to achieve them will lead to errors in decision making. The root of this problem lies in the increase of risk sources and its evolution into hidden trouble of accidents, the transformation of social organization makes the role adjustment of some decision makers unsuitable, the administrative decision-making behavior is difficult to form strong institutional and normative constraints, and the ability quality is undeserved lacking. Can cause mistakes in decision making. Decision-making mistakes are divided into non-responsibility mistakes and administrative decision-making errors. Non-responsibility-free error refers to the unavoidable failure and not to blame of the decision-maker based on the exploratory decision made to a certain political pursuit or scientific ideal due to the limitation of historical cognition. For administrative decision-making blunders, the degree and nature of responsibility for decision-making mistakes should be determined according to the importance of decision-making objects, the imperfection of decision-making knowledge, and the seriousness of harmful consequences The forms of responsibility are accountability, disciplinary responsibility, administrative responsibility and criminal responsibility.
