【摘要】:劳务派遣作为一种新型的企业用工形式,受到越来越多企业的青睐。它是一种突破传统单纯的双方劳动关系,而转变为三方主体的特殊用工类型,即包括劳务派遣机构、实际用工单位以及劳动者个人。其中,劳务派遣公司与劳动者形成法律上的劳动关系,签订书面的劳动合同,并受到劳动法以及相关法律法规的约束;而劳务派遣公司并不实际用人,而将劳动者派遣至用工单位,并依照双方签订的劳务派遣合作协议,享有权利并承担相应的义务;同时,劳动者与实际用工单位不存在法律上规定的劳动关系,劳动者仅仅为用工单位提供实际劳动力,双方权利、义务不受劳动法调整。实践中多因其具有用工灵活、成本较低等特点而被企业采用。 正是因为打破了传统的仅有双方便形成的简单劳动关系,使其在实际应用过程中也出现了不同于以往劳动关系所具有的利与弊,给企业人力资源管理带来新的挑战。 内蒙古伊泰集团在企业战略和业务转型的关键时期,开始引进劳务派遣这一用工方式。本研究试图从企业用工实际出发,全面分析劳务派遣管理过程中遇到的问题,寻找出行之有效的解决问题的方法及对策,为公司劳务派遣相关管理的发展提供一种科学、有效的评价标准,为进一步规范企业整体用工提供参考。
[Abstract]:As a new type of employment in enterprises, labor dispatch is favored by more and more enterprises. It is a special type of employment which breaks through the traditional simple labor relationship between the two sides and becomes the main body of the three parties. Include labor dispatch organization, actual employment unit and laborer individual. Among them, labor dispatch company and laborer form the legal labor relation, sign the labor contract in writing. And be bound by labor law and related laws and regulations; But the labor dispatch company does not actually employ the person, but dispatches the laborer to the employment unit, and according to the labor dispatch cooperation agreement signed by both sides, enjoys the right and undertakes the corresponding obligation; At the same time, there is no legal labor relationship between the laborer and the actual employer. The laborer only provides the actual labor force for the employer and both sides have the right. Obligation is not regulated by labor law. In practice, it is adopted by enterprises because of its flexible employment and low cost. It is precisely because of breaking the traditional simple labor relations formed by only two sides, that it also has the advantages and disadvantages different from the previous labor relations in the practical application process. Bring new challenge to enterprise human resource management. In the key period of enterprise strategy and business transformation, Inner Mongolia Yitai Group began to introduce labor dispatch as a mode of employment. This study attempts to start from the actual employment of enterprises. Comprehensive analysis of the problems encountered in the process of labor dispatch management, find out effective solutions to the problem and countermeasures, for the development of the company's labor dispatch related management to provide a scientific, effective evaluation standard. To further standardize the overall employment of enterprises to provide a reference.
