浅谈国外矿业资源管理制度经验对我国的启示

【摘要】：矿业用地制度是矿产资源所有权、矿业权和政府管理权之间规范的制度安排。现实中我国矿业用地使用权与矿业权矛盾较为明显,矿产与土地资源难以得到充分有效利用,也导致了环境破坏难以及时恢复的问题,原因主要在于我国矿业用地的取得及使用管理制度规定存在不足,推动矿业用地管理制度改革已迫在眉睫。本文通过对国外矿业用地的取得及使用管理制度分析,比较国内矿业用管理地制度情况,并总结经验启示,以期为我国及地方矿业用地管理改革决策提供参考。
[Abstract]:Mining land system is a standard system arrangement between mineral resource ownership, mining right and government management right.In reality, the contradiction between mining land use right and mining right is obvious in our country, and it is difficult to make full and effective use of mineral and land resources, which also leads to the problem that environmental damage is difficult to recover in time.The main reason is that there are some deficiencies in the management system of mining land acquisition and use in China, and it is urgent to promote the reform of mining land management system.Based on the analysis of foreign mining land acquisition and management system, this paper compares the situation of domestic mining land management system, and summarizes the experience and enlightenment, in order to provide a reference for our country and local mining land management reform decision-making.
