东莞市电力行业政府监管问题研究

【摘要】：电力行业关系国计民生,随着政府监管模式“管制”走向“服务”,政府对电力行业的监管调整也必将拉开帷幕。电力行业监管是政府监管特定于电力行业领域,按照相应的法律法规和国务院相关规定,由国家电力监管机构对电力领域内的经济活动,实施行政干预。电力行业监管以国家法律法规为依据,重点对电力领域中的价格、服务质量和投资等方面实施监管,力求进一步维护电力市场正常秩序,保障行业投资者、经营者及使用者的合法权益和社会公共利益,确保电力系统安全、可靠、稳定运行,促进产业的持续、健康发展。实施电力行业政府监管,是社会、群众和行业的内存必然需要。加强电力行业政府监管工作有助于防止电力产业自然垄断属性的过分膨胀,有效地规避了电力垄断企业通过电力价格垄断来猎取超额利益,影响消费者的合法权益,实现了企业生存与消费者利益的友好兼顾：加强电力监管,有助于为国家发展提供动力支持,及兼顾处理好电力能源的开发利用矛盾问题,加强对环境成本的监管,减少环境污染,为社会的持续发展提供有力保障；有助于进一步规范电力市场竞争,推动电力普遍服务,推动电力行业的健康发展。本文将重点阐述东莞的电力行业监管现状,主要包括东莞市电力行业政府监管工作已取得的成效、存在问题及其问题的原因分析等内容。由于考虑到发电领域监管与输、配、售电领域监管的差异性,且与用户用电关系的紧密联系,本章节的研究重点将集中于东莞市输、配、售电领域的监管。而输、配、售电领域,目前主要由国家电网公司和中国南方电网有限责任公司垄断经营,因此,分析东莞电力行业监管工作现状,则主要是分析电力监管机构对东莞供电局及其企业运营的监管。多年来,随着电力监管改革的不断推进,东莞电力行业政府监管工作取得了可喜的成绩。一是电力监管部门不断强化法律法规刚性执行监管,加强业务流程管控,严把业扩业务报装和工程实施关口,较好地实现了企业的良好发展和遵纪守法、规范经营；二是强化营业厅服务,进一步强化营销管理平台建设,不断完善客户信息有效性和完整性,全方面促进服务质量持续上升,推动服务平台建设、业务流程管理等方面全面提高；三是加强突发事件应用管控,推出样板工程建设,提供工程建设质量,较好地实现了电网的安全、稳定运行；四是加强工程预算审核和规划建设关口,实现电网投资建设适度超前,较好地为东莞地区提供了电力支持。但在取得成果的同时,一些问题也逐步显现,如电力监管法律法规不够完善,法规适用性不够,指导电力监管的配套法规和可操作性缺乏；电力监管部门职能交叉、分散；政府监管手段亟待完善：对电力产业发展的内生力等方面缺乏有力的监管；社会监督作用发挥不足。法治,是现在电力监管体制的显著特征之一,完善的法律体系是确保市场交易规范化开展的基础。完善、设置科学的监管体制建设有助于进一步推进电力监管工作的深入开展,更好地发挥电力监管职能。同样地,监管机制的进一步优化,群众监督等作用的充分发挥,对电力监管工作的发展有力强力的推动作用。因此,结合结合当前存在的电力监管问题,结合我国市场开放的总体趋向,在第五章节中,论文将重点针对东莞电力行业监管工[作中存在的不足,对如何进一步完善东莞电力行业监管提出了一些对策建议；加强立法,进一步完善电力监管法律体系建设；加强体制建设,进一步化解监管职能交叉、分散问题；转变思路,进一步推进简政放权改革；以人为本,进一步推进科学发展观建设；充实监管渠道建设,进一步扩大社会监督作用。东莞电力行业政府监管工作既具有个性也具有共性,对东莞电力监管问题的剖析同样地具有较强的针对性、客观性和现实指导意义。社会不断向前,市场进一步放开,必将对全社会、公众带来更大的刺激与改变。今年,我国对进一步开放电力市场已作出了部署,广东省深圳市已列为试点,电力配输与售环节逐步实现分离,而东莞市也将于今年迎来直购电改革。电力关系千家万户,电力产业与国家发展紧密相连。深入研究电力监管改革,不仅对研究电力市场改革具有着参考价值,对于进一步思考未来我国电力改革的方向,也同样有着积极的意义。
[Abstract]:The regulation of electric power industry is to protect the legitimate rights and interests of the power industry and to protect the legitimate rights and interests of the industry .

In order to enrich the construction of supervision channels and further expand the role of social supervision , the government supervision work of Dongguan power industry has both individuality and commonness , and it has strong pertinence , objectivity and realistic significance to the analysis of Dongguan power supervision problems . This year , China has already made the deployment of further open electric power market , and the power distribution and sale links of Guangdong Province have been closely connected . In order to further study the reform of electric power supervision , not only has the reference value to the research of power market reform , but also has positive significance for further thinking about the direction of power reform in the future .
