大陆与台湾地区公益基金会治理比较研究

【摘要】：作为一种典型的非营利组织,公益基金会在我国社会公益慈善事业中起着至关重要的作用,但公益基金会运作失范事件亦是频频发生,问题层出不穷,严重阻碍了公益事业的健康有序发展。如何解决大陆公益基金会的治理问题并规范自身行为,已迫在眉睫。台湾地区与大陆公益基金会的生成模式和生长环境差别较大,其治理结构及治理机制必然存在着差异,但两岸有着同样的文化传承和历史背景,因此,将大陆与台湾地区公益基金会治理状况进行对比,同西方发达的国家相较而言,更具有借鉴意义。同时,对两岸公益基金会的治理进行比较研究,有助于公益基金会相关政策环境的营造,并在深化两岸公益基金会组织交流合作的基础上,密切两岸人民的合作交流与来往,推进两岸社会和谐发展。本文基于大陆与台湾地区公益基金会治理比较研究视角,首先,分析了大陆与台湾地区公益基金会的发展历程,并在此基础上,从规章制度方面对组织的治理机构和治理机制进行对比;然后,运用层次分析法,根据大陆与台湾公益基金会的治理实践,构建具有层级性的两岸公益基金会治理评价指标体系,通过专家判断矩阵,计算出各项指标的权重,继而对大陆及台湾地区发展较好的教育类基金会进行问卷调查,综合问卷得分与指标的权重,得出被调研基金会的综合得分,并对其治理现状进行评价,总结发现在治理过程中存在的突出问题;最后,从法律规范、治理结构和治理机制三方面来对比总结两岸公益基金会的治理,并得出两岸公益基金会治理的启示,提出完善大陆公益基金会治理的建议,包括完善公益基金会治理的法律规范、治理结构和优化治理机制等。
[Abstract]:As a typical non-profit organization, public welfare foundation plays a vital role in the social charity in China, but the misoperation of public welfare foundation also occurs frequently and problems emerge in endlessly. Seriously hindered the healthy and orderly development of public welfare. How to solve the governance of the mainland public welfare foundation and regulate their own behavior. Taiwan region and mainland China public welfare foundation generation model and the growth environment difference, its governance structure and the governance mechanism must have the difference, but the cross-strait has the same cultural heritage and the historical background. Therefore, comparing the governance of the mainland and Taiwan with that of the western developed countries, it is more meaningful to draw lessons. At the same time, a comparative study on the governance of the cross-Strait public welfare foundation is carried out. It is helpful for the establishment of the relevant policy environment of the public welfare foundation, and on the basis of deepening the exchange and cooperation between the two sides of the strait, the cooperation and exchanges between the people on both sides of the strait will be close. Based on the comparative study of the governance of the mainland and Taiwan, this paper first analyzes the development process of the mainland and Taiwan public welfare foundation, and on this basis. From the aspects of rules and regulations, the organization's governance institutions and governance mechanisms are compared; Then, according to the governance practice of the mainland and Taiwan public welfare foundation, this paper constructs a hierarchical evaluation index system of cross-Strait public welfare foundation governance, through the expert judgment matrix. Calculate the weight of the indicators, and then to the mainland and Taiwan developed better education foundation questionnaire survey, comprehensive questionnaire score and index weight, get the comprehensive score of the research foundation. And the current situation of its governance evaluation, summarized and found in the governance process of outstanding problems; Finally, from the legal norms, governance structure and governance mechanism to compare and summarize the governance of cross-Strait public welfare foundations, and draw inspiration from the governance of cross-Strait public welfare foundations, and put forward suggestions to improve the governance of mainland public welfare foundations. Including the improvement of public welfare foundation governance of the legal norms, governance structure and optimization of governance mechanisms.
