农村集体土地征收政策执行研究

【摘要】：农村集体土地征收为我国的经济发展和城市化推进提供了用地保障。但同时随着我国城镇化速度加快,农村集体土地征收范围扩大,因农村集体土地征收政策执行而引发的征地事件时有发生,已经成为影响社会稳定发展的重大问题。对农村集体土地征收政策执行进行研究不仅有助于完善农村集体土地征收政策执行以维护社会稳定发展,还可以拓宽农村集体土地征收政策的研究视角,具有一定的理论意义。出于以上考虑,本文对农村集体土地征收政策执行进行研究。本文主要是运用史密斯政策执行模型对农村集体土地征收政策执行进行研究。首先对我国农村集体土地征收政策执行现状和成效进行分析,透过征地过程中农民利益诉求的焦点问题,探究出我国农村集体土地征收政策执行存在的具体问题,然后结合存在的具体问题从理想化政策、执行机构、目标群体、环境因素等四个影响因素对农村集体土地征收政策执行情况进行分析,探究农村集体土地征收政策执行中存在的问题和原因,最后依据前述分析提出相应的对策。通过对我国农村集体土地征收政策执行进行研究,本文发现在农村集体土地征收政策执行中农民利益诉求的焦点问题是补偿标准过低、缺乏后续保障、侵占征地补偿款、逼签逼征骗征、征地信息不公开、审批手续不合法等。由此透视出我国农村集体土地征收政策执行中存在政策不合理、执行机构行政方式不合法、给予被征地农民的社会保障不健全、不利的政策执行环境等问题。造成农村集体土地征收政策执行存在问题的原因在于缺乏农民参与土地征收政策制定机制,执行机构官员观念转换不到位,农民对土地高度依赖,农民维权意识增强,土地政策监督机制不完善。完善土地征收政策执行的途径包括制定合理完善的土地征收政策,规范执行机构行为,提高失地农民政策认同与征地意愿,优化政策执行环境。
[Abstract]:Rural collective land expropriation has provided land security for the economic development and urbanization of our country. However, with the acceleration of urbanization in China, the scope of rural collective land expropriation has been expanded. Land expropriation incidents caused by the implementation of the rural collective land expropriation policy have occurred from time to time. The research on the implementation of rural collective land expropriation policy is not only helpful to improve the rural collective land expropriation policy implementation in order to maintain the stable development of society. It can also broaden the research perspective of rural collective land expropriation policy, which has certain theoretical significance. This paper studies the implementation of rural collective land expropriation policy. This paper mainly uses Smith policy implementation model to study the implementation of rural collective land expropriation policy. To analyze the current situation and effectiveness, Through the focus of farmers' interests in the process of land expropriation, this paper explores the specific problems in the implementation of the rural collective land expropriation policy, and then combines the existing specific problems from idealized policies, executive agencies, target groups. The paper analyzes the implementation of rural collective land expropriation policy by four factors, such as environmental factors, and probes into the problems and reasons existing in the implementation of rural collective land expropriation policy. Finally, according to the above analysis put forward the corresponding countermeasures. Through the study of rural collective land expropriation policy implementation, this paper found that in the implementation of rural collective land expropriation policy, the focus of farmers' interest demands is too low compensation standard. Lack of follow-up protection, encroachment of compensation for land expropriation, forced signature and forced collection of land requisition, information of land requisition, illegal examination and approval procedures, etc. From this perspective, there are unreasonable policies in the implementation of the policy of collective land expropriation in rural areas in our country. The administrative method of the executive organ is illegal, and the social security provided to the peasants who have been expropriated is not perfect, The problems in the implementation of the rural collective land expropriation policy are due to the lack of farmers' participation in the formulation of land expropriation policy, the inadequate transformation of the concept of the executive agency officials, and the high dependence of farmers on land. The ways to improve the implementation of land expropriation policy include making reasonable and perfect land expropriation policy, standardizing the behavior of executive agencies, raising the policy identity and land expropriation willingness of land-losing farmers. Optimize the policy implementation environment.
