【摘要】：在民族国家现代化发展过程中,传统以地域为对象所构建的少数民族管理模式已显现出滞后性,生态型民族自治正成为当代民族自治发展的一种新实现形式,并对传统的民族治理结构形成了挑战。生态型民族自治是以国家主权统一为前提,通过制度规范民族群体与个体的权利义务范畴,构建出一种以民族成员个体获得等质性权利义务为核心的分层治理系统,其主要特点在于能够借由个体身份为基础来认知民族诉求和界定民族权利,形成细化分类的权利义务点式保障系统。这种模式的提出不仅可以释放对于民族认同和国家认同双重标准的讨论,而且可以分类分层地保护少数民族发展及其文化传承权利。生态型民族自治在现代治理构架之中,亦呈现出由多民族国家内部和国际社会共同认可的法理根据与发展空间,从而成为未来多民族国家治理模式多元化的新探索。
[Abstract]:In the course of the modernization development of the nation-state, the traditional management mode of ethnic minorities, which is based on the region, has shown the lag, and the ecological national autonomy is becoming a new realization form of the development of the contemporary national autonomy. The ecological national autonomy is based on the unification of national sovereignty and standardizes the categories of rights and obligations of ethnic groups and individuals through the system. This paper constructs a hierarchical governance system with the core of obtaining the equal rights and obligations of the individual members of a nationality. Its main characteristic is that it can recognize the national demands and define the national rights by the basis of individual identity. Forming a system of point-of-rights and obligations safeguards with detailed classification. This model can not only release the discussion of the double standards of national identity and national identity, In addition, it can be classified and stratified to protect the development of ethnic minorities and their rights of cultural inheritance. In the framework of modern governance, ecological national autonomy also presents a legal basis and space for development that is jointly recognized by the multinational countries and the international community. Therefore, it will become a new exploration of multi-national governance mode in the future.
