我国非营利组织综合监管研究

【摘要】：随着我国社会改革的不断推进,我国非营利组织稳步发展,各类非营利组织通过提供公共物品和服务等途径逐步参与到社会管理中来,在社会管理中扮演着重要的角色。但在我国非营利组织飞速发展的同时,腐败和违法违规行为和一些不合时宜的规章制度制约了非营利组织的进一步发展,如何实现对我国非营利组织的综合监管,促进非营利组织良性发展,已成为我国非营利组织研究的重要课题。本文以非营利组织及其监管为研究对象,通过对相关资料的分析,阐述了文章的研究背景与意义,界定了相关概念。从公共责任,委托-代理,志愿失灵与多元治理理论视角对我国非营利组织的监管进行了理论分析,明确了对非营利组织进行监管的必要性。接着梳理了我国非营利组织及其监管的发展历程,从立法,政府,社会和内部四个方面探究了我国非营利组织监管存在的问题及其成因。接着通过借鉴发达国家的监管经验,结合我国实际国情,为完善我国非营利组织的综合监管提出了具体建议措施,包括完善相关法规,改革政府监管模式,拓宽社会监管渠道和提升内部监管水平四方面,最后对我国非营利组织综合监管内部各主体关系,体系构成,约束和激励措施进行了分析,以期为提升我国非营利组织监管水平提供一些参考。
[Abstract]:With the development of social reform in our country, the non-profit organizations in our country have developed steadily, and all kinds of non-profit organizations have gradually participated in the social management through the provision of public goods and services. It plays an important role in social management. However, with the rapid development of non-profit organizations in China, corruption and illegal practices and some untimely rules and regulations restrict the further development of non-profit organizations. How to realize the comprehensive supervision of the non-profit organizations in China and promote the benign development of the non-profit organizations has become an important topic in the research of the non-profit organizations in our country. This paper takes the non-profit organizations and their supervision as the research object, through the analysis of the relevant information, This paper expounds the research background and significance of the article, defines the relevant concepts. From the perspective of public responsibility, principal-agent, voluntary failure and pluralistic governance theory, this paper makes a theoretical analysis on the supervision of non-profit organizations in China. It clarifies the necessity of the supervision of NPOs. Then, it combs the development of NPOs and their supervision in China, from the perspective of legislation, government, This paper probes into the problems and causes of the supervision of non-profit organizations in China from the four aspects of society and interior. Then, by drawing lessons from the regulatory experience of developed countries and combining the actual situation of our country, In order to improve the comprehensive supervision of non-profit organizations in China, the paper puts forward some specific suggestions, including perfecting relevant laws and regulations, reforming the mode of government supervision, widening the channels of social supervision and raising the level of internal supervision. Finally, this paper analyzes the relationship, system structure, constraints and incentive measures of the internal comprehensive supervision of NPOs in China, in order to provide some references for improving the supervision level of NPOs in China.
