西藏自治区政府推行权力清单制度研究

【摘要】：西藏自治区地方政府建立和完善权力清单制度,是推动政府依法、全面、正确履行管理职能的一项重要举措,是全面推进依法治藏、全面深化改革的一次有益探索,是实现地方政府治理能力和治理体系建设的重要一步。西藏自治区地方政府认真贯彻执行了党中央、国务院部署的一项重要改革任务,积极推行权力清单制度,推动权力清单制度落地生效,不断深化“放管服”等有关工作,编制自治区政府权责清单、行政权力运行流程图和服务指南的配套制度。本文在对现存关于“权力清单制度”的文献进行阅读整理之后,将“治理现代化”作为其视角对民族地区进行分析的文献较少,故本文将“治理现代化”作为其视角,引入到对“权力清单”的研究之中。通过对西藏自治区各厅级单位的考量,结合其相关权威网站的资料,在对西藏关于实施“权力清单”的相关情况进行调查之后,其有诸多不足,决定借鉴其他省份关于实施“权力清单制度”的办法,深入分析自治区所面临相关难题的各种原因,并试图寻找具有可行性的解决方案:第一章为权力清单制度的理论和相关概念界定。本章分两个部分:第一部分为相关概念界定,界定了善治、国家治理能力现代化、权力清单以及权力清单制度四个概念。第二部分为相关理论介绍,主要为权力制约理论、善治理论、政府再造理论,介绍权力清单制度实施的理论基础。第二章为西藏自治区政府推行权力清单制度的背景和取得的成就。首先分析我国中央政府和地方政府推行权力清单制度的社会背景,主要是从推进国家治理现代化和地方政府治理现代化的迫切任务,社会活力亟需进一步激发的改革诉求,人民对透明高效、清廉政府的强烈期盼和电子信息化浪潮的冲击等四个方面提出,中央政府和地方政府需要推行权力清单制度的社会背景。其次介绍了西藏自治区地方政府在推行权力清单制度中取得的成就,主要从涉及范围广,落实程度深,重视程度高,规范了公共资源交易,压缩了权力寻租空间和权力公开化,突出政府的阳光行政等五个方面来说西藏自治区地方政府推行权力清单制度所取得成就。第三章为西藏自治区在推行权力清单制度中面临问题的原因分析。从权力清单制度缺乏法律约束,行政体制约束,运行的环境不完善以及监督机制不健全等四个大方面来分析西藏自治区在推行权力清单制度中面临的问题。第四章为西藏自治区政府在推行权力清单制度中的对策和建议。从政府层面、市场层面、社会层面和法律层面四个层面来提出有针对性的对策建议,来促进西藏自治区权力清单制度的实施,加快西藏自治区政府治理能力现代化的建设。本文认为,推行西藏自治区权力清单制度建设,虽然还存在很多问题,还有很多路要走,但是依靠“老西藏精神”,发扬吃苦、忍耐、团结、奉献的老西藏精神,任何问题就会迎刃而解、柳暗花明。西藏自治区各行政职能部门要确实做好行政权力清单的制定和实施,做到权力可执行、可监督、可问责,解决各行政职能部门不作为、懒政、怠政等问题,建设成人民满意、信任的政府。
