论政府数据开放与信息公开——对现有观点的反思与重构

【摘要】：信息公开和数据开放是当前政府信息资源管理中的两大政策体系。通过对现有文献和英美两国政策的总结与反思,本文尝试重构政府数据开放与信息公开的关系。基于对信息和数据本质的再认识,在不否认理论渊源上信息公开强调知情权,数据开放侧重资源利用的前提下,本文认为数据开放无论从概念、法律、价值和管理上都是信息公开的一部分。实际的政策制定可以在保证政策逻辑基本自洽的前提下放松本文的概念约束,在技术层面对信息和数据做出合理划分,但是制度上应致力构建统一的政府数据资源管理体系。
[Abstract]:Information disclosure and data openness are two major policy systems in the management of government information resources. Through the summary and reflection of the existing literature and the policies of the United States and the United States, This paper attempts to reconstruct the relationship between the opening of government data and the disclosure of information. Based on the re-understanding of the essence of information and data, the open information emphasizes the right to know without denying the theoretical origin, and the opening of data emphasizes the utilization of resources. This paper holds that data openness is a part of information disclosure in terms of concept, law, value and management. Practical policy making can relax the conceptual constraints of this paper on the premise of ensuring the basic self-consistency of policy logic. On the technical level, the information and data should be divided reasonably, but the unified government data resource management system should be set up systemically.
