我国农村校车服务公私合作供给中的政府监管研究

【摘要】:近三年来,我国发生了50余起校车安全事故,其中重大事故13起。如此触目惊心的数字,将校车服务、校车服务的安全运营带进大众的视野之中,校车安全这一话题逐渐引起了社会各界的关注,各级政府也开始着重发展校车事业。校车的含义(用于接送不少于5名处于义务教育阶段的学生及其照管人员上下学的车辆)和属性(公益性)决定了校车服务是一种特殊的公共服务,并且政府必须是它的第一责任主体。随着教育体制改革、城镇化脚步的逐渐加快以及“撤点并校”政策的大力实施,我国农村地区对于校车服务的需求愈发强烈。但是农村地区的教育资源投入少、财政资金压力巨大,政府不可能作为单一供给主体提供校车服务,因此政府有必要将市场主体引入农村校车服务中,合作供给模式可以缓解政府的财政压力,维护教育资源的公平配置。但是,当市场主体进入校车服务后,政府对于校车服务的监管变得更加复杂,多个供给主体必然导致权责不清、滋生腐败等现象,而这些不良现象的产生势必影响到校车服务的顺利开展和安全运营。为了从根本上解决校车服务的安全问题,政府部门必须提升对校车服务的监管力度、改善监管方式。本文以芝加哥学派波斯纳提出的公共利益理论为指导,将校车服务市场化作为农村校车服务顺利开展的前提,以政府监管作为切入点,从校车服务的立法、运营过程中的监管以及校车服务的进、退机制为出发点,力争解决解决农村校车服务中的监管问题,希望以完善政府对校车服务的监管保障农村儿童享受到安全的校车服务。笔者将本论文分为五大章节(三部分),第一部分主要是提出论文要解决的主要问题,并针对农村校车服务中的问题介绍必要的背景、理论依据和相关研究。第二部分则是结合农村校车服务中政府监管的现状,分析问题产生的原因,然后进行必要的理性分析。最后,根据我国的实际情况,提出解决问题的方法,力争为农村校车服务公私合作供给模式下的政府监管提供有效的改进意见,最终保障农村校车服务安全的、顺利的运营。
[Abstract]:In the past three years, more than 50 school bus safety accidents have occurred in China, of which 13 are major accidents. Such shocking figures bring the safe operation of school bus service and school bus service into the public's view. The topic of school bus safety has gradually attracted the attention of all walks of life. Governments at all levels have also begun to focus on the development of school buses. The meaning of school buses (used to transport not less than 5 students in compulsory education and their carers to and from school) and attributes (commonweal) determines school bus service. Is a special kind of public service, And the government must be the main body of its primary responsibility. With the reform of the education system, the pace of urbanization is gradually quickening and the policy of "withdrawing points and combining schools" has been vigorously implemented. The demand for school bus service in rural areas of our country is more and more intense. However, the education resources in rural areas are less and the financial capital pressure is enormous, so the government can not provide school bus service as a single main supply. Therefore, it is necessary for the government to introduce the market main body into the rural school bus service. The cooperative supply mode can relieve the financial pressure of the government and maintain the fair allocation of educational resources. However, when the market main body enters the school bus service, The government's supervision of school bus services has become more complicated, and many suppliers will inevitably lead to unclear powers and responsibilities and corruption. However, the emergence of these undesirable phenomena will inevitably affect the smooth development and safe operation of the school bus service. In order to fundamentally solve the safety problem of the school bus service, government departments must enhance the supervision of the school bus service. Under the guidance of the theory of public interest put forward by Posner of Chicago School, this paper regards the marketization of school bus service as the prerequisite for the smooth development of school bus service in rural areas, and takes government supervision as the starting point from the point of view of the legislation of school bus service. The supervision in the operation process and the advance and retreat mechanism of the school bus service are taken as the starting point to solve the problem of supervision in the rural school bus service. I hope to improve the government supervision of school bus services to ensure rural children enjoy safe school bus services. This paper is divided into five chapters (three parts, the first part is to propose the main problems to be solved. And introduce the necessary background, theoretical basis and related research in view of the problems in rural school bus service. The second part is to analyze the reasons of the problems in combination with the current situation of government supervision in rural school bus service. Finally, according to the actual situation of our country, put forward the solution to the problem, and strive to provide effective improvement advice for the government supervision under the mode of public-private cooperative supply of rural school bus service. Finally ensure the rural school bus service safety, smooth operation.
