行政机关基层公务员法治思维培养研究

【摘要】：法治思维是人依据法律规则、法律原则和法治精神,依据一定的逻辑,分析问题、解决问题的思维模式。行政机关基层公务员作为国家行政权力的执行者、与社会公众最直接的接触者,在行政过程中其法治素质的高低关乎政府的形象,关乎法治政府的建设水平。然而,当前行政机关基层公务员群体中,仍然存在人治观念根深蒂固漠视行政中的法律效果、权力思维盛行破坏法治环境、服务观念缺失行政效率低下的现象,因此有必要对基层公务员进行法治思维的培养。培养公务员的法治思维,不仅应当通过提高公务员准入的法律素质门槛、增强培训、在考核中增加法治思维内容的考核等,以提高基层公务员的法律素质;而且需要通过建设行政机关内部的法治环境和社会法治环境,来构建公务员法治思维培养的法治环境;另外,基层公务员法治思维的培养也需要在立法、司法的环节为其提供基础,完善公务员法治思维培训制度,并通过考核与奖惩检验和保障法治思维培养的效果。做到以上的要求,才能培养基层公务员的法治思维,进而有利于行政机关基层公务员自身建设、有利于法治政府的建设、有利于国家法治一体化建设。
[Abstract]:The thinking of rule by law is the mode of thinking that people think according to legal rules, legal principles and spirit of rule of law, according to certain logic, analyzing problems and solving problems. The most direct contact with the public is that the quality of the rule of law in the administrative process is related to the image of the government and the level of construction of the government ruled by law. There still exists the phenomenon of deep-rooted disregard of the legal effect in administration, the prevalence of power thinking, the destruction of the environment of rule by law and the lack of administrative efficiency in the concept of "rule of man". Therefore, it is necessary to train grass-roots civil servants' thinking on the rule of law. In order to cultivate civil servants' legal thinking, we should not only raise the threshold of civil servants' access to the law, enhance training, and increase the examination of the contents of the rule of law thinking in the examination, etc. In order to improve the legal quality of civil servants at the grass-roots level; moreover, it is necessary to build the legal environment for civil servants to train their thinking on the rule of law by building the environment of the rule of law within the administrative organs and the environment of the rule of law in society. The cultivation of grass-roots civil servants' thinking on the rule of law also needs to provide the foundation for it in the process of legislation and administration of justice, to perfect the training system of civil servants' thinking on the rule of law, and to ensure the effect of the cultivation of the thinking of rule of law through examination, reward and punishment, so as to achieve the above requirements. Only in this way can we cultivate the thinking of ruling by law of the civil servants at the grass-roots level, which is conducive to the self-construction of the civil servants at the grass-roots level in administrative organs, to the construction of the government ruled by law and to the integration of
