大部制视角下广州市路政一体化法治研究

【摘要】:“大部制”改革,即大部门体制改革,因其具备显著优势而成为不少国家和地区普遍采用的政府机构改革模式。近年来,我国政府机构也将其作为深化行政体制改革的一个重要环节,进行了机构改革。在大部制改革的浪潮之下,如何建立一个廉洁高效、运转协调、行为规范的道路路政管理体制,是一个值得深入探讨的问题。广州市作为国内道路路网发达的城市之一,在交通行政管理方面所遇到的问题,与其他城市、地区具有一定的普遍性;另外,广州市作为广东省人民政府所在地的市,无论在行政级别还是立法权限上均具有一定的代表性。本文将通过文本分析、实证分析、调研走访、文献分析等研究方法,从法治的角度探索如何在广州市大部制改革的契机下实现具有协同特色的道路路政一体化管理模式,拟制定公路与城市道路统一适用的地方性法规,以一体化的具有协同创新特色的管理模式实施道路路政管理,促进交通行政权的统一,推动广州市道路路政管理高效运作,从而达到加强和规范道路路政管理,保障道路完好、安全和畅通的道路行政管理目的。本文分为五个部分对“大部制视角下广州市路政一体化法治研究”这一命题进行探讨。首先,本文界定了文章涉及的基本概念,阐述了大部门制改革及道路路政管理的内涵。其次,回顾了广州市政府机构改革的历史沿革,着重从法律适用与管理机制两个方面进行探讨,归纳了广州市道路路政管理在大部制改革背景下的发展、现状与问题。再者,通过借鉴国内外路政管理的有益做法并分析总结,探索具有广州市特色的一体化的协同管理模式,分别从合法性、合理性、必要性的角度进行可行性分析。然后从制定统一适用的地方性法规、在大部制改革的契机下整合部门职权并健全内部职能体系、设立具有协同特色的工作机制、完善多元监督渠道等角度提出构建广州市道路路政一体化管理模式的建议。最后,总结全文的思路和意义。
[Abstract]:"Big department system reform, namely department system reform, the reform of government institutions mode is widely used in many countries and regions because of its advantages. In recent years, China's government agencies will also serve as an important part of deepening the reform of administrative system, carried out institutional reforms. This thesis consists of five parts of the "study" the integration of rule of law in Guangzhou city from the perspective of the proposition.
