我国政府推行权力清单制度存在的问题和对策研究

【摘要】：权力清单制度的提出是在党的十八届三中全会上,它的目的是要梳理政府行政权力,规范行政权力的运行,实现依法行政,它的建立和推行对我国政府实行全面深化改革,建立法治政府、有限政府和服务型政府具有重要意义。但是由于政府权力清单制度缺少理论支撑,在建立和推行的过程中存在许多的问题,需要针对这些问题提出建议对制度进行完善,使其能更有助于规范政府行政权力的运行,这也是本文的研究目的。为了更好的完成文章,本文主要采用文献研究法、比较分析法和访谈法进行研究,对现有的有关权力清单制度的研究成果进行整理和研究,分析政府权力清单制度的概念和性质,结合各级政府权力清单制度的发展现状,提出目前我国政府权力清单制度发展存在的问题,并提出相应的建议和对策。本文重点是研究政府推行权力清单制度过程中存在的问题和对策,从界定权力清单制度的基本内涵和性质出发,论述了我国政府推行权力清单制度的理论背景和现实背景,说明了我国推行权力清单制度的必要性。之后对权力清单制度的提出和发展历程进行了整理和总结,简单介绍了我国各级政府公布权力清单的状况,总结了这一制度推行过程中取得的成就。通过分析我国政府权力清单制度的发展现状,指出我国政府在推行权力清单制度的过程中还存在许多问题,包括涉权各方的思想认识有待转变,权力清单制度的制定标准有待统一,执行过程不规范,在推行过程中的法律制度不够健全,也缺乏完善的配套制度。为了更好的推行权力清单制度,本文提出了相应的对策建议,主要是包括转变涉权各方的思想认识,统一权力清单制度的制定标准,理顺政府间的事权关系,建立健全权力清单制度推行过程中的相关法律制度,完善相关配套制度。通过提出对策建议,以期能促进权力清单制度体系的完善,规范政府行政权力的运行。通过整篇文章的完整论述,指出权力清单制度的建设对政府规范行政权力,促进全面深化改革和加快依法治国建设具有重要意义,是实现我国治理能力和治理体系现代化的重要部分,政府要在已取得成就的基础上不断的完善和推进权力清单制度,这个过程是充满困难的,不是一蹴而就的,需要不断努力的克服各种阻碍和挑战,才能保障权力清单制度的有效推行。
[Abstract]:The power list system was put forward at the third Plenary session of the 18th CPC Central Committee. Its purpose is to sort out the administrative power of the government, standardize the operation of the administrative power, and realize administration by law. Its establishment and implementation will comprehensively deepen the reform of the Chinese government.It is of great significance to establish a government ruled by law, a limited government and a service-oriented government.However, due to the lack of theoretical support for the government power list system, there are many problems in the process of establishment and implementation. It is necessary to put forward some suggestions to perfect the system, so that it can help to standardize the operation of government administrative power.This is also the purpose of this paper.In order to complete the article better, this article mainly uses the literature research method, the comparative analysis method and the interview method to carry on the research, carries on the collation and the research to the existing research result about the power list system.This paper analyzes the concept and nature of the government power list system, and puts forward the problems existing in the development of the government power list system at present, and puts forward the corresponding suggestions and countermeasures in the light of the current situation of the development of the government power list system at all levels.This paper focuses on the study of the problems and countermeasures in the process of government carrying out the power list system, and discusses the theoretical and practical background of the implementation of the power list system in our country, starting from the definition of the basic connotation and nature of the power list system.It explains the necessity of carrying out the power list system in our country.After that, the paper puts forward and summarizes the system of power list, briefly introduces the status of power list published by all levels of government in our country, and summarizes the achievements made in the process of implementation of this system.Based on the analysis of the current situation of the government's power list system, it is pointed out that there are still many problems in the process of carrying out the power list system, including the need to change the ideological understanding of the parties involved in the right.The system of power list needs to be unified, the implementation process is not standardized, the legal system in the process of implementation is not perfect enough, and there is also a lack of perfect supporting system.In order to better carry out the power list system, this paper puts forward the corresponding countermeasures and suggestions, mainly including changing the ideological understanding of the parties involved in the right, unifying the standards of the power list system, and straightening out the relationship between the governments.Establish and perfect the relevant legal system in the process of carrying out the power list system and perfect the relevant supporting system.By putting forward countermeasures and suggestions, this paper hopes to promote the perfection of power list system and standardize the operation of government administrative power.Through the complete discussion of the whole article, it is pointed out that the construction of the power list system is of great significance for the government to standardize the administrative power, to promote the overall deepening of the reform and to speed up the construction of governing the country according to law.It is an important part of realizing the modernization of our country's governance capacity and governance system. The government should constantly improve and promote the power list system on the basis of the achievements already made. This process is full of difficulties and not accomplished overnight.Continuous efforts are needed to overcome obstacles and challenges in order to ensure the effective implementation of the list of powers system.
