行政监督视角下信访制度创新研究

【摘要】：信访制度是具有中国特色的政治制度设计,它是党群联系的重要渠道;是为人民服务宗旨的重要体现;是具体实行“三个代表”重要指导思想表现;是公民履行自己权利的途径;同时它代表着中国民主政治的发展程度。中国的信访制度从1951年建立之初距今已有六十多年的的历史,已经成为中国公民表达民意、维护权利的一个基本制度保障,为公民监督政府及其工作人员的行政行为提供了有效便捷的平台。信访是社会矛盾表现的一个重要窗口,这一窗口为构建和谐社会、解决重大社会问题提供了落脚点和依据。随着进入社会转型的关键时期,各种社会矛盾日益凸显,随之而来的反映各方各面的信访也日益增多,出现“信访洪峰”与“信访难”的突出问题,这些问题的产生归根到底是信访制度在实际运行中的功能与制度设计之间出现矛盾和偏差导致的。本文通过梳理各个学者对信访功能的论述,提出自己的观点即“以信访的行政监督功能为中心的多元化功能论”。通过强化信访的行政监督来实现信访制度的重构与创新。从解决当前信访制度中存在的问题出发,将行政监督的思想引入到信访领域,通过构建专门的信访监督机构来解决现在信访存在的问题,特别是由于缺乏监督而引起的社会不安因子,从根本上提升信访制度的效率。本文共有六个部分,第一、二部分主要是对选题的背景、意义、国内外的研究现状、研究的方法及思路进行简单的梳理对涉及的理论概念进行介绍。第三部分是对现行的信访制度在缺乏行政监督背景下的现状及原因进行分析,得出本文的观点:以监督功能完善信访制度是信访改革创新的根本出路;第四部分阐述构建信访监督委员会的具体方面,信访监督委员会的机构设置、人员配置、权力范围以及其监督体系;第五和第六部分是对构建的信访监督委员会的合理性和可行系进行制度、思想、人员等方面的论证。本文的创新之处就在于分析信访制度的核心功能为监督功能并以此功能为核心的信访机构是怎样的模式,而且结合具体的地方进行现实的操作。
[Abstract]:The petition system is a political system design with Chinese characteristics, which is an important channel for connecting the Party and the masses, an important embodiment of the purpose of serving the people, a manifestation of the concrete implementation of the important guiding ideology of the "three represents";It represents the development of Chinese democratic politics.China's petition and visit system has a history of more than 60 years since it was established in 1951. It has become a basic institutional guarantee for Chinese citizens to express public opinion and safeguard their rights.It provides an effective and convenient platform for citizens to supervise the administrative behavior of the government and its staff.Petition is an important window of social contradictions, which provides a foothold and basis for building a harmonious society and solving major social problems.With the entry into the critical period of social transformation, various social contradictions are becoming increasingly prominent, and the number of letters and visits reflecting all sides is increasing day by day, resulting in the prominent problems of "letters and visits" and "difficulties in letters and visits".In the final analysis, these problems are caused by the contradiction and deviation between the function of the petition system in the actual operation and the system design.Through combing out the scholars' exposition on the function of petition, this paper puts forward his own viewpoint, that is, the pluralistic function theory centered on the function of administrative supervision of letters and visits.Through strengthening the administrative supervision of letters and visits to realize the reconstruction and innovation of petition system.In order to solve the problems existing in the current letter and visit system, the idea of administrative supervision is introduced into the field of letters and visits, and the problems existing in the present letters and visits are solved through the construction of a special monitoring agency for letters and visits.Especially because of the lack of supervision caused by social unrest, fundamentally improve the efficiency of the petition system.There are six parts in this paper. The first and second parts mainly introduce the background, significance, domestic and foreign research status, research methods and ideas.The third part is to analyze the current situation and reasons of the current petition system under the background of the lack of administrative supervision, and draw the point of view of this article: perfecting the petition system with the supervision function is the fundamental way out for the reform and innovation of the petition system;The fourth part describes the specific aspects of the establishment of the letters and visits supervision committee, the establishment of the organization, the staffing, the scope of power and its supervision system.The fifth and sixth parts demonstrate the rationality and feasibility of the supervision committee.The innovation of this paper lies in the analysis of the mode of the petition organization whose core function is the supervision function and which is the core function, and carries on the practical operation in combination with the concrete place.
