政府信息公开、自由裁量权与标准化制度嵌入

【摘要】：政府信息公开过程中自由裁量权的存在,是应对区域差异、法律滞后性和多维的个性化信息公开需求的需要,但不当的自由使用又存在过度解读与滥用的可能。嵌入标准化制度,建立政府信息公开ISO质量管理标准化体系,全方位实施信息公开过程和内容的标准化,有望从制度层面上约束自由裁量权的"脱嵌行为"。正确界定上位法与下位法、标准化与个性化、强制性标准与自主性标准、国家标准与地方标准之间的关系,从源头上嵌入标准化制度和理念,推动政府信息公开向精准化、法治化、透明化转变。
[Abstract]:In the process of government information disclosure, the existence of discretion is the need to deal with regional differences, legal lag and multi-dimensional personalized information disclosure needs, but improper free use is possible to over-interpret and abuse.Embedding the standardization system, establishing the ISO quality management standardization system of government information disclosure, and implementing the standardization of the information disclosure process and content in all directions, is expected to restrict the "unembedded behavior" of the discretionary power from the system level.Correctly defining the relationship between upper and lower methods, standardization and individuation, mandatory standards and autonomous standards, national standards and local standards, embedding standardization systems and concepts from the source, promoting the government information openness to precision,Rule by law, transparency changes.
