行政管理视角下的温州市童工问题治理研究

【摘要】：童工问题开始于工业革命时期,至今仍在较大范围内存在,是“人类良知最不能容忍的耻辱”,也是人类社会必须面对的沉重话题。为解决这一问题,国际社会一直采取各种措施、各种方式去面对和努力。时至今日,童工问题虽然在一定程度上得到很大的缓解,但在一些经济较为落后的发展中国家仍较为严重。当今中国仍处于社会主义初级阶段,经济发展处于快速转型期,为追求利益最大化而雇佣童工的不法企业数量仍不可忽视。在我国,童工问题无法根治的原因在于社会各方面综合作用,作为行政管理部门,需从事前预防、事中监控、事后监察三方面入手,运用法律手段、行政手段和社会服务进行综合整治。本文分四部分对温州市童工问题进行分析:第一部分在介绍温州市自然经济社会概况的基础上,分析温州市使用童工现状,重点介绍温州市禁止使用童工采取的政策和措施,并在此基础上介绍使用童工问题引发的系列社会问题。第二部分通过问卷的方式,分析总结出部分童工产生的原因及该群体的特点。介绍温州市查处的三起使用童工典型案例,并分析劳动行政部门禁止使用童工政策失灵的部分原因。第三部分总结温州市禁止使用童工政策失灵的原因,包括童工现象产生的原因和政策失灵的原因。第四部分从法律、行政管理、社会三个层面提出温州市禁止使用童工的对策建议,着重介绍提高劳动监察效率的对策建议。
[Abstract]:The problem of child labor began in the period of industrial revolution and still exists in a wide range. It is the most intolerable disgrace of human conscience, and it is also a heavy topic that human society must face.To solve this problem, the international community has been taking various measures, various ways to face and efforts.Nowadays, child labor problem has been alleviated to some extent, but it is still more serious in some developing countries.At present, China is still in the primary stage of socialism, the economic development is in a rapid transition period, and the number of illegal enterprises that employ child labor in order to maximize the benefits can not be ignored.In our country, the reason why the problem of child labour cannot be cured is because of the comprehensive role of all aspects of society. As an administrative department, it is necessary to engage in three aspects of prevention, monitoring in matters, and supervision after the incident, and use legal means.Administrative means and social services should be comprehensively rectified.This paper is divided into four parts to analyze the problem of child labor in Wenzhou. The first part, on the basis of introducing the natural economic and social situation of Wenzhou, analyzes the current situation of using child labour in Wenzhou, with emphasis on the policies and measures adopted by Wenzhou to prohibit the use of child labour.And on this basis introduce the use of child labor caused by a series of social problems.In the second part, the causes of child labor and the characteristics of this group are analyzed and summarized by questionnaire.This paper introduces three typical cases of child labor in Wenzhou City, and analyzes some reasons for the failure of labor administrative department's policy of prohibiting child labor.The third part summarizes the reasons of the policy failure of prohibiting child labor in Wenzhou, including the causes of child labor and the reasons of policy failure.The fourth part puts forward countermeasures and suggestions to prohibit the use of child labor in Wenzhou from three aspects of law, administration and society, with emphasis on the countermeasures and suggestions to improve the efficiency of labor supervision.
