单维管制抑或协商共治:邻避冲突治理的路径选择

【摘要】:邻避风险治理已成为当前社会治理的新难题。邻避冲突的根源在于邻避设施所致的风险分配不均衡,这种不均衡反映出传统的单向度管制型行政模式的失灵。在价值多元的社会,面对多元的利益诉求,政府垄断决策、压制抗争的治理方式已呈现应对无力的困局,亟须转变治理模式,革新治理手段,以回应失衡的利益结构。协商民主理论主张不同主体之间通过平等的对话、协商和参与,达成共识,实现利益平衡,为邻避冲突治理提供一个理想图景。赋予协商过程以规范性,使平等协商成为一种制度化的程序,优化行政决策模式,完善利益平衡机制,由单维管制治理模式迈向多元协商共治模式,是缓解邻避矛盾、缓释邻避冲突的可行性路径。
[Abstract]:Adjoining risk management has become a new problem of social governance. The root of conflict avoidance lies in the imbalance of risk distribution caused by adjacent facilities, which reflects the failure of the traditional administrative mode of one-dimensional control. In a society with multiple values, in the face of pluralistic interest demands, the government monopolizes the decision making and the governance mode of suppressing the struggle has presented a difficult situation to cope with. It is urgent to change the governance mode and innovate the governance means in order to respond to the unbalanced interest structure. The theory of deliberative democracy advocates that through equal dialogue, consultation and participation, the different subjects reach a consensus, realize the balance of interests, and provide an ideal prospect for the governance of conflict avoidance. To give the consultation process normative, to make equal consultation an institutionalized procedure, to optimize the administrative decision-making mode, to perfect the mechanism of interest balance, and to move from the single-dimensional regulatory governance model to the multi-consultative co-governing mode is to alleviate the conflict avoidance between neighbors. Feasible path of slow-release neighbor conflict avoidance.
