监察全面覆盖的可能与限度——兼论监察体制改革的宪法边界

【摘要】：国家监察体制改革欲祛除现行监察体制之监督对象过窄的弊病,以实现监察全面覆盖之改革目标。然而改革的变法特质决定了监察体制改革必然需要突破现行宪法和法律的规定,监察全面覆盖目标的达致同样需"仰仗"宪法和法律的相应修改,但改革以及由此而来的宪法修改不得触及宪法制度之核心内容。故此,置于特定宪制环境之下的监察体制改革,其监察全面覆盖之改革目标亦不乏相当的限度,即监察机关须尊重权力机关的宪法地位,并须恪守审判独立的宪法原则。
[Abstract]:The reform of the state supervision system aims to eliminate the defects of the existing supervision system which is too narrow in order to achieve the goal of comprehensive coverage of supervision. However, the nature of reform determines that the reform of the supervisory system must break through the provisions of the current constitution and laws, and the goal of comprehensive coverage of supervision also needs to be "dependent" on the corresponding amendments of the Constitution and the law. But the reform and the resulting constitutional changes must not touch the heart of the constitutional system. Therefore, the reform of the supervisory system placed under a specific constitutional environment is limited to the goal of full coverage of supervision, that is, the supervisory organ must respect the constitutional status of the organ of power and abide by the constitutional principle of judicial independence.
