海南推行负面清单管理制度的探讨与设计

【摘要】：全文包括引言、正文四个主文部分和结论,约2.4万字符。负面清单,亦称投资者境外准入制度。将政府不允许的事项以类似于购物清单的方式一一列举出来。对于“购物清单”没有列举的事项那么都是可以参与进行的。该种类似于黑名单的投资管理制度在国际贸易日益发达的今天已经成为一种国际惯例。此种负面清单管理模式是当下我国转变政府职能,释放市场基础配置功能的一个重要切入点。是我国市场经济体制改革进入深水区的重要配套内容之一。海南处于我国最南端,地理位置重要,区位条件优越。在国家打造海南国际旅游岛和发展一带一路经济带的大战略环境下,迫切需要转变经济和行政管理体制。本文通过分析负面清单管理模式的内涵及其背后法理,梳理其他国家的负面清单管理制度的现状。介绍并指出上海自由贸易试验区负面清单管理模式运行现状,带来的积极影响。对海南推行负面清单管理做出制度设计以及在海南实施负面清单管理之下制度可能带来的负面影响和从制度完善的角度提出应对相应策略和粗浅建议。本文分为四个部分：第一部分,主要论述负面清单管理模式的概念发端、起源、背后所蕴含的“法无禁止则可为”的法理。并简要的分析我国当下需要推行负面清单管理制度的原因是经济深化改革和对外经济交往和贸易谈判的迫切需求。第二部分,主要重点梳理负面清单制度在国内外的实践现状经验以分别从国外实践的经验、上海自由贸易试验区的实践经验和国内其它自贸区的实践经验三个部分进行介绍。第三部分,主要论述海南推行负面清单管理制度的必要性和重要性以及实践过程当中可能面临的挑战及其应对挑战的策略。第四部分,是本文的重点提出对海南负面清单管理制度从投资领域制度设计、行政公共领域制度设计和配套措施设计三个部分详细论述。每个部分又分别从总体编制思路,分行业、分资本来源、监管制度、分类别进行设计是整篇文章的重点。
[Abstract]:The full text includes the introduction, the main body four parts and the conclusion, about 24000 characters. Negative list, also known as investors outside the access system. List the things that the government does not allow in a way similar to a shopping list. All items that are not listed on the shopping list can be involved. The blacklist-like investment management system has become an international practice in the increasingly developed international trade. This kind of negative list management mode is an important entry point to transform the government function and release the market basic allocation function. Is our country market economy system reform enters the deep water area one of important supporting contents. Hainan is located in the southernmost part of our country, the geographical position is important, the location condition is advantageous. Under the strategic environment of building Hainan international tourism island and developing Belt and Road economic belt, it is urgent to change the economic and administrative management system. By analyzing the connotation of negative list management mode and its legal theory, this paper combs the current situation of negative list management system in other countries. This paper introduces and points out the current situation of the negative list management mode in Shanghai Free Trade Test area and its positive impact. This paper designs the system of carrying out the negative list management in Hainan and the possible negative influence of the system under the implementation of the negative list management in Hainan and puts forward corresponding strategies and superficial suggestions from the point of view of the perfection of the system. This paper is divided into four parts: The first part mainly discusses the legal principle that the concept of negative list management mode originates and originates. And briefly analyzes the reasons why China needs to carry out the negative list management system is the urgent need of deepening economic reform and foreign economic exchanges and trade negotiations. In the second part, the author mainly introduces the current situation of negative list system at home and abroad in order to introduce the experience from foreign countries, Shanghai free trade test area and other domestic free trade zones. The third part mainly discusses the necessity and importance of carrying out the negative list management system in Hainan, the challenges that may be faced in the process of practice and the strategies to deal with the challenges. The fourth part is the emphasis of this paper on Hainan's negative list management system from the investment field system design, administrative public domain system design and supporting measures design three parts in detail. Each part separately from the overall compilation idea, divides the industry, the capital source, the supervision system, the classification carries on the design is the entire article the emphases.
