中央地方关系视角下的行政审批制度改革

【摘要】：建国后很长一段时间里,行政审批作为政府管理经济和社会的一种重要手段,曾在国家发展过程中发挥过至关重要的作用。伴随着社会主义市场经济的开始和进一步深化,繁冗且不断增多的行政审批一方面使中央政府不堪重负,另一方面还严重制约日益增多和丰富的经济活动。行政审批是行政权力的一个极为重要的方面,它不仅涉及国家和社会(或政府与市场)之间的关系,还因为涉及事权转移而成为中央与地方之间关系中的重要一环。2001年开始的大规模行政审批改革既是国家向社会放权,同时也是中央向地方的权力转移。本文根据国务院历次行政审批改革的文件,以直观表格形式展现当前行政审批制度改革的现状,发现其中仍然存在不少问题。文章从央地间事权和财权的分配出发,分析行政审批改革的动力机制,并理清这些问题存在的原因,对于深入推进行政审批制度改革具有重要的意义。本文共分为七个部分,分别是绪论、文献综述、建国后行政制度改革和央地关系变化的历史轨迹、2001年以来的行政审批制度改革情况整理、行政审批改革的动力机制分析、对中国现行行政审批制度改革的启示和结论。通过依据不同时期的权力配置和财税政策对建国后我国各阶段行政制度的改变和所体现的央地关系变化进行的梳理,以对2001年至今历次行政审批改革的调整类型、项目及所涉及的部门所进行的整理,从央地关系的层面出发,分析得出。结合改革的动力机制,从权力配置和运行机制两个角度,提出对现在正在进行的行政审批制度改革的建议。
[Abstract]:For a long time since the founding of the people's Republic of China, administrative examination and approval, as an important means of government management of economy and society, has played a vital role in the process of national development. With the beginning and further deepening of the socialist market economy, the heavy and increasing administrative examination and approval on the one hand makes the central government overburdened, on the other hand, it also seriously restricts the increasing number and rich economic activities. Administrative examination and approval is an extremely important aspect of administrative power. It involves not only the relationship between the state and society (or between the government and the market), The large-scale administrative examination and approval reform, which began in 2001, is not only the devolution of power from the state to the society, but also the transfer of power from the central to the local level. According to the documents of the previous administrative examination and approval reform of the State Council, this paper presents the current situation of the reform of the administrative examination and approval system in the form of an intuitive table, and finds that there are still many problems in it. Starting from the distribution of administrative power and financial power between central and local authorities, this paper analyzes the motive mechanism of administrative examination and approval reform, and clarifies the causes of these problems, which is of great significance for further promoting the reform of administrative examination and approval system. This paper is divided into seven parts: introduction, literature review, the historical track of the reform of administrative system after the founding of the people's Republic of China and the change of the relationship between central and local authorities, the arrangement of the reform of the administrative examination and approval system since 2001, and the analysis of the motive mechanism of the reform of administrative examination and approval. The enlightenment and conclusion to the reform of China's current administrative examination and approval system. Through combing the change of administrative system and the change of the relationship between central and local government in various stages after the founding of the people's Republic of China according to the power distribution and fiscal and taxation policies of different periods, this paper tries to adjust the types of administrative examination and approval reform since 2001. Combined with the dynamic mechanism of the reform, this paper puts forward some suggestions on the reform of the administrative examination and approval system from the two angles of power allocation and operation mechanism.
