我国推广街区制的正当性研究

【摘要】:街区制作为一种城市建设布局的形式,被赋予城市规划的功能。故在我国推广街区制的目的是为了改善城市交通、路网结构等一系列城市问题。遗憾的是,街区制政策的出台,受到诸多质疑,使得街区制遇到了较大的推广阻力。这些阻力的背后实际上是社会各界对街区制正当性的怀疑。因此,研究我国推广街区制的正当性问题,有其现实必要性。同时,在推广街区制的试点工作起步阶段,本文梳理相关质疑为街区制在我国推广的正当性提供法理支撑,显得尤为必要。文章首先廓清了街区制在我国的法律定位,紧接着梳理了街区制政策引发的各种争议,之后从合理性、必要性、可行性三个角度论证了我国存在推广街区制的正当性,然后从法律视角对街区制的推广进行了规范设计。具体由以下四个部分构成:第一部分是街区制的法律定位。该部分首先界定了街区制的基本概念,其次分析了推广街区制中涉及的主体,最后通过梳理推广街区制所涉及的法律关系,明确了街区制的法律定位。第二部分是我国推广街区制正当性的质疑之声。该部分主要论述街区制政策引发的争议,包括对小区安全保障的疑虑、对小区居住环境的担忧、对独占权共享化的排斥、对道路打开方式的否定。第三部分是我国推广街区制正当性的存在基础。该部分从合理性、必要性和可行性三个角度论证街区制在我国推广的正当性基础。在合理性分析中,街区制在我国的推广得到了容忍义务原则、情势限制理论、财产权义务观念以及政府管理权合法性的支持。在必要性分析中,从缓解交通拥堵、完善路网结构、提高资源利用和构建和谐街区生活的实际需求表明街区制在我国推广的必要性。在可行性分析中,从域外街区制的成功经验示范、国内早期实践探索经验示范、历史建筑中设计理念的影响、成本与收益分析的效益证成四个方面论证了街区制在我国推广的可行性。第四部分是我国推广街区制的规范设计。该部分针对街区制推广工作的开展设计了若干规范,分别是提高公众对街区制的接受度,合理评估街区制引起的利益损失,严格认定街区制中的公共利益,确定公共地役权为道路公共化的路径。
[Abstract]:Block making is a form of urban construction layout, which is endowed with the function of urban planning. Therefore, the purpose of popularizing block system in China is to improve urban traffic, road network structure and a series of urban problems. Unfortunately, the introduction of block system policy, by many doubts, block system encountered greater resistance to promotion. Behind these resistance are the doubts about the legitimacy of the block system from all walks of life. Therefore, it is necessary to study the legitimacy of popularizing block system in our country. At the same time, in the initial stage of the pilot work of popularizing the block system, it is particularly necessary for this article to sort out the related doubts to provide legal support for the legitimacy of the district system in our country. The article firstly clarifies the legal position of block system in our country, then combs all kinds of disputes caused by district system policy, then proves the legitimacy of popularizing block system in our country from three angles of rationality, necessity and feasibility. Then from the legal point of view, the promotion of block system is standardized design. Specific by the following four parts: the first part is the legal positioning of the block system. This part firstly defines the basic concept of block system, then analyzes the main body involved in popularizing block system, finally, through combing the legal relationship involved in popularizing block system, the legal position of block system is clarified. The second part is the voice of questioning the legitimacy of popularizing block system in our country. This part mainly discusses the disputes caused by the district system policy, including the doubts about the security of the residential area, the concern about the residential environment, the exclusion of the exclusive right to share, and the negation of the way of road opening. The third part is the existence foundation of the legitimacy of popularizing block system in our country. This part demonstrates the legitimacy foundation of block system in our country from three angles of rationality, necessity and feasibility. In the analysis of rationality, the promotion of block system in our country is supported by the principle of tolerance obligation, the theory of circumstance restriction, the concept of property rights and obligations, and the legitimacy of government management right. In the analysis of necessity, the necessity of popularizing block system in our country is indicated from the actual demand of alleviating traffic congestion, perfecting road network structure, improving the utilization of resources and constructing harmonious street life. In the feasibility analysis, from the successful experience demonstration of the extraterritorial block system, the domestic early practice exploration experience demonstration, the historical building design idea influence, This paper proves the feasibility of popularizing block system in our country from four aspects of cost and benefit analysis. The fourth part is the standard design of popularizing block system in our country. In this part, some specifications are designed for the extension of block system, which are to improve the public acceptance of block system, to evaluate the loss of interest caused by block system, and to strictly identify the public interest in block system. Determine the public easement as the path of road publicity.
