北京市网约车准入机制和政府监管研究

【摘要】:如今,网约车作为出租汽车出行的新方式,在我国已经得到广泛普及。然而,网约车近年来发展出现了各种问题,引发了社会热议,更让社会对于网约车相关准入机制和政府监管相关法律法规有了更大的期待。经过多年的研究制定,2016年底,我国交通运输部和包括北京市在内的各主要地区交通主管部门相继发布了网约车的经营服务管理办法。然而这些法律文件的出台不仅没有打消公众疑虑,其准入机制和政府监管的内容反而引发了社会争议和部分行业主体的反对。本文从网约车发展的大趋势出发,在明确网约车性质的基础上,通过对北京市网约车现行准入机制和政府监管活动的现状、问题的分析,就如何完善北京市网约车准入机制和政府监管提出了针对性建议,为北京市网约车设计了互联网监管系统。本文除去绪论和结语,共分为四个部分:第一部分,对巡游车、网约车、准入机制和政府监管的相关概念进行了界定,对相关的理论进行了阐述,以期为分析北京市网约车准入机制和政府监管存在的问题提供理论基础。第二部分“北京市网约车准入机制研究”,该部分主要对我国巡游车和网约车准入机制的内容进行了阐述和对比,分析北京市网约车准入机制的现状,表明了准入机制行的突出问题并提出了对策。第三部分“北京市网约车政府监管研究”,该部分分析了北京市网约车政府监管中存在的问题及原因,并就问题提出了解决对策。第四部分“北京市网约车互联网监管系统设计”,该部分分析互联网对于政府监管的意义,设计适合北京市网约车使用的互联网监管系统,阐述了该系统的运行机制,分析了建立互联网监管系统的意义。
[Abstract]:Nowadays, as a new way to travel by taxi, it has been widely used in our country. However, in recent years, there have been a variety of problems in the development of ride-hailing, which has caused a heated discussion in the society, which makes the society have a greater expectation for the access mechanism and the relevant laws and regulations of the government. By the end of 2016, the Ministry of Communications and Transportation of China and the transportation authorities of major regions, including Beijing, have successively issued the management measures for the operation and service of net-chartered vehicles. However, the introduction of these legal documents has not only not reassured the public, but also triggered social disputes and opposition from some industry subjects by the entry mechanism and the contents of government supervision. Based on the general trend of the development of net-ride-hailing, and on the basis of clarifying the nature of net-ride-hailing, this paper analyzes the current situation and problems of the current access mechanism and the government supervision activities of the net-ride-hailing in Beijing. This paper puts forward some suggestions on how to perfect the access mechanism and the government supervision of Beijing's ride-hailing network, and designs an Internet supervision system for Beijing's net-ride-hailing system. Apart from the introduction and conclusion, this paper is divided into four parts: the first part defines the related concepts of cruise vehicle, net car, access mechanism and government supervision, and expounds the relevant theories. In order to provide a theoretical basis for the analysis of the access mechanism and the problems of government supervision. The second part is "the Research on the access Mechanism of Beijing Net-chartered car". This part mainly expounds and compares the contents of the access mechanism of China's tour vehicle and the net-chartered car, and analyzes the present situation of the access mechanism of Beijing's Net-chartered car. This paper shows the outstanding problems of access mechanism and puts forward some countermeasures. The third part is "the Research on the Government Regulation of Beijing Net-chartered car". This part analyzes the problems and causes in the government supervision of Beijing Net-chartered car, and puts forward some countermeasures to solve the problems. The fourth part is "the design of the internet supervision system of Beijing net car charter". This part analyzes the significance of the internet to the government regulation, designs the internet supervision system suitable for the Beijing net car-sharing system, and expounds the operation mechanism of the system The significance of establishing Internet supervision system is analyzed.
