【摘要】：政府决策是行政机关管理国家公共事务的重要手段,它规范和指导着行政机关的行政过程,政府做出何种决策以及如何做出决策几乎决定着国家行政机关的行政效果。虽然有许多技术上的因素影响着政府决策的进行和成效,但伦理仍然对之有不可取代的影响,尤其是在新的时代背景下,伦理对政府决策的影响越来越显著。本文试图通过对政府决策中的伦理因素展开论述,建构起一个符合伦理的政府决策模型,并针对现实存在的具体决策伦理问题提出建议,希望能够对政府决策相关伦理研究有所帮助。本研究从地方政府决策蕴含的伦理属性入手,以地方政府决策行为为研究对象。本研究主要以理论分析、现实求证研究为主,采用多学科交叉(管理学、行政学、伦理学)的研究方法,在国内外行政伦理学、伦理决策学研究综述分析的基础上,指出政府应当具有伦理职能,政府决策具有伦理属性,并集中体现在政府决策行为中,地方政府决策主体应秉持的伦理价值观是地方政府进行伦理决策的前提,也是必要条件。本论文研究着重探讨地方政府决策中的伦理因素存在方式及其对地方政府决策产生的影响。首先对本文涉及的主要概念地方政府决策和伦理因素进行界定分析。其次从政府决策与伦理的相关性、伦理因素在政府决策中的存在方式及其对政府决策的影响三个维度进行论述,探究政府决策的伦理属性。其中重点从政府决策的构成要素切入,分析并总结出伦理因素在地方政府决策中的存在方式——客观上外显为政府决策中的“行政伦理关系”、“政府伦理精神”、伦理冲突与伦理困境。除了对政府决策中的伦理因素的理论分析,还探究了地方政府决策实践中的伦理两难实例。再次,就地方政府决策中的伦理失范现象予以详细分析,并深入探究政府决策伦理失范的伦理归因。最后基于政府伦理决策过程影响因素的综合分析,建构出一个“伦理人—地方政府”的决策模型,结合对地方政府决策中伦理失范的起因的分析,有针对性地为地方政府决策中的伦理建设提出一些建议。
[Abstract]:Government decision-making is an important means for administrative organs to manage national public affairs. It regulates and guides the administrative process of administrative organs, and what kind of decisions the government makes and how to make decisions almost determines the administrative effect of state administrative organs. Although there are many technical factors that affect the progress and effect of government decision-making, ethics still has an irreplaceable influence on it, especially in the new era, the influence of ethics on government decision-making is becoming more and more obvious. By discussing the ethical factors in government decision-making, this paper attempts to construct an ethical decision-making model of government, and put forward some suggestions on the practical ethical problems in decision-making. It is hoped that it will be helpful to the ethical research of government decision-making. This research starts with the ethical attribute of local government decision-making, and takes the local government decision-making behavior as the research object. This research is mainly based on theoretical analysis, practical verification research, multi-disciplinary research methods (management, administration, ethics), on the basis of domestic and foreign administrative ethics, ethical decision-making research review and analysis. This paper points out that the government should have the ethical function, the government decision has the ethics attribute, and concentrated in the government decision-making behavior, the local government decision-making subject should uphold the ethics value is the local government carries on the ethics decision-making premise, is also the necessary condition. This paper focuses on the existence of ethical factors in local government decision-making and its influence on local government decision-making. First of all, the main concepts involved in the local government decision-making and ethical factors are defined and analyzed. Secondly, it discusses the relationship between government decision-making and ethics, the existence of ethical factors in government decision-making and its influence on government decision-making, and probes into the ethical attributes of government decision-making. This paper analyzes and summarizes the existing mode of ethical factors in local government decision-making from the point of view of the constituent elements of government decision-objectively, it is the "administrative ethical relationship" and "the spirit of government ethics" in government decision-making. Ethical conflicts and ethical dilemmas. In addition to the theoretical analysis of ethical factors in government decision-making, it also explores the ethical dilemma in the practice of local government decision-making. Thirdly, this paper analyzes the phenomenon of ethical anomie in local government decision making in detail, and probes into the ethical attribution of ethical anomie in government decision making. Finally, based on the comprehensive analysis of the influencing factors in the process of government ethical decision-making, a decision model of "ethical personal-local government" is constructed, and the causes of ethical anomie in the decision-making of local governments are analyzed. Put forward some suggestions for the ethical construction of local government decision-making.
