政府职能转变视角下的权力清单制度研究

【摘要】:党的十八届三中全会提出“推行地方各级政府及其工作部门权力清单制度,依法公开权力运行流程”,是为规范政府权力运行、建设法治政府和服务型政府而采取的一项重大改革举措。本文以政府职能转变为视角,主要采取文献法和调查研究的方法,在吸收借鉴现有研究成果的基础上,从权力清单制度的基本理论切入,总结归纳了近年来各地各部门探索权力清单制度的实践经验,深入分析我国推行权力清单制度面临的现实难题和主要障碍,最后就我国全面推行这一制度提出具有针对性和可操作性的对策建议。具体来讲,本文除导论部分对研究背景与意义、研究现状与评估、研究内容与框架、研究思路与方法作整体概述,结论部分对整个研究予以概括总结之外,核心部分包括以下四章:第一章为权力清单制度的基本理论分析。本章分三个部分对权力清单制度的基本理论展开分析:第一部分为行政权力解析,从行政权力的内涵、来源、主要特征及其与政府职能的内在联系四个方面,析清行政权力的基本属性,特别是分析了行政权力与政府职能互为依存、不可分割的内在联系之后,就自然导入本研究的主题——以政府职能转变为视角来研究政府权力清单制度。第二部分界定了权力清单制度的内涵与、特征、主体客体、目的目标、基本原则、制定依据等权力清单制度的基本问题。第三部分围绕创造良好发展环境、提供优质公共服务、维护社会公平正义三个维度,着重论述了推行权力清单制度对政府职能转变的重大现实意义。第二章为我国推行权力清单制度的现状分析。首先分析我国政府职能转变进程,尔后择选起步较早、做法较为典型的河北、浙江、广州三个省市作了综述,总结了这一制度推行过程中的做法和成效,对其规律特点加以提炼并归纳为三种模式。同时,对国家部委公开权力清单的状况也作了简要介绍。第三章为我国推行权力清单制度面临的问题障碍分析。重点围绕思想认识不到位、相关法律制度不配套、政府内外关系未理顺、权力调整中各方利益博弈突出、技术支撑不成熟等五个方面,对推行权力清单制度面临的难题和障碍进行了深入分析。通过上述分析,揭示出在改革步入深水区的当下,推行权力清单制度不会一帆风顺,也不会一蹴而就,提示各级决策者看待权力清单制度不能过于简单化、常规化,而宜客观分析、理智对待,大胆探索、依法推进。第四章为我国推行权力清单制度的对策建议分析。对照前一章关于问题与障碍的分析,重点围绕转变涉权各方思想观念、配套健全相关法律制度、进一步理顺政府内外关系、破解各方利益博弈格局、完善相关技术支撑等五个方面,结合一些典型经验提出有针对性的对策建议。本文认为,影响我国治理体系与治理能力现代化的一个主要障碍就是权力运作的封闭性与模糊性。各级政府应在宪法和法律的授权下做该做的事情,放掉不该拥有的职权,促进政府职能回归本位,使市场真正发挥资源配置的决定性作用,推进社会组织、公民依法自治进程,最终形成符合中国国情和现代政府建设规律的政府职责体系。因此,必须把权力清单制度置于我国全面深化改革的时代背景中和政府职能转变的视角下去认识和理解,通过建立和推行权力清单制度,明确政府与市场、社会和公民互动过程中的职责与边界,使四者在未来国家和社会治理中依法扮演好各自的角色。行政体制改革作为政府的一场“自我革命”,期间充满困难、阻力与挑战,必须注意改革的系统性、关联性和协同性,确保权力清单制度全面有效推行。
[Abstract]:In the third Plenary Session of the 18th CPC Central Committee, the party put forward "the implementation of the power list system of local governments at all levels and their work departments and the operation process of power in accordance with the law". It is a major reform measure to regulate the operation of government power and build a government under the rule of law and a service-oriented government. On the basis of absorbing the existing research achievements and drawing on the basic theory of the power list system, this paper summarizes the practical experience of exploring the system of power list in various parts of the country in recent years, and deeply analyzes the difficult problems and main obstacles in the implementation of the system of power list in our country. Finally, we carry out this one in an all-round way. The system puts forward the countermeasures and suggestions that are pertinent and maneuverable. Specifically, this paper, in addition to the introduction to the research background and significance, the research status and evaluation, the research content and framework, the research ideas and methods as a whole, the conclusion part summarizes the whole research, the core part includes the following four chapters: the first chapter is the power. The basic theory of the list system is analyzed in this chapter. This chapter analyzes the basic theory of the power list system in three parts: the first part is the analysis of the administrative power, from four aspects of the connotation, source, main features and the internal relations with the government functions, and the analysis of the administrative power and the analysis of the administrative power and the analysis of the administrative power. After the government functions are interdependent and inseparable, they naturally introduce the subject of this study - the change of government functions as the perspective to study the system of government power list. The second chapter is the analysis of the status quo of the implementation of the power list system in China. After the early selection, the three provinces and cities of Hebei, Zhejiang and Guangzhou, which are more typical, are reviewed. The practice and effectiveness of the system are summarized and the characteristics of the system are summarized and summarized into three modes. At the same time, the status of the public power list of the state ministries is briefly introduced. The third chapter is the right to carry out the right of our country. This paper analyzes the problems and obstacles facing the system of force list, focusing on five aspects, which are not in place, the relevant legal system is not matched, the internal and external relations of the government are not rationalized, the interests of all parties are played out, and the technical support is not mature, and the problems and obstacles facing the implementation of the power list system are deeply analyzed. It reveals that the implementation of the power list system will not be smooth and easy to achieve at the moment when the reform enters the deep water area. It suggests that the policy makers at all levels should not be too simple and conventional to look at the power list system, but should be objective analysis, rational treatment, bold exploration and the promotion of the law. The fourth chapter is the Countermeasures for the implementation of the power list system in China. On the basis of the analysis of the problems and obstacles in the previous chapter, we focus on the transformation of the ideas of the parties involved in the power involved, the complete set of relevant legal systems, the further rationalizing of the internal and external relations between the government, the solution of the game pattern of the interests of all parties, and the improvement of the relevant technical support, and some typical experiences and suggestions are put forward in this paper. The paper argues that a major obstacle to the modernization of governance and governance in China is the closeness and fuzziness of power operation. Governments at all levels should do what should be done under the authorization of the Constitution and law, release the functions and powers that should not be owned, promote the return of government functions, and make the market truly play a decisive role in the allocation of resources. To promote social organization and citizens' self-government process in accordance with the law of China, it will eventually form a government responsibility system which is in line with the national conditions of China and the law of modern government construction. Therefore, it is necessary to recognize and understand the power list system in the perspective of the times and the transformation of government functions, and to establish and carry out the system of power list. Define the responsibilities and boundaries of the interaction between the government and the market, the society and the citizens, and make the four play their respective roles in the future state and social governance. As a "self revolution" of the government, the reform of the administrative system is full of difficulties, resistance and challenge, and must pay attention to the systematicness, relevance and synergy of the reform, and the right to ensure the reform. The force list system is fully and effectively implemented.
