我国土地信访工作的困境与完善

【摘要】：城市化推动中国社会急剧转型和变迁,造成了很多社会矛盾,因农村集体土地征收而产生的问题尤为典型。在农村集体土地征收过程中,违法用地、征地补偿、权属纠纷频繁发生,这也导致了近年来涉地信访数量高居不下,造成了很多负面影响。本文基于这一背景,以笔者在江苏省N市的土地信访工作经验为基础,研究当前我国土地信访工作在全国层面和地方层面的现状,并尝试提出了完善土地信访工作的建议。本文首先研究了土地信访的理论,对信访和土地信访的概念予以探讨和界定,并且从社会冲突理论和公共治理理论的角度阐释了土地信访的应然状态,即土地信访工作公共治理的信息反馈、权利救济和民主参政的渠道,其核心功能是维护土地公有制,并为社会主义经济建设服务。之后,本文揭示了当前我国土地信访工作的现状,以此与土地信访的应然状态形成对比,以突显当前土地信访的问题:第一,在国家层面,土地信访的制度体系基本形成,土地信访主体目的趋利化,土地信访途径多样,反映问题集中;第二,在地方层面,通过对江苏N市一系列土地信访数据和案例的分析,可以看出在地方上的土地信访工作繁重,重访缠访的行为屡见不鲜并且土地信访的管辖问题异常复杂,而且地方上土地信访的信息化建设不足、工作队伍力量薄弱,均给土地信访制度的落实带来很大阻碍。最后,本文分析了造成以上问题的原因,包括:土地信访制度不完善、地方政府经济发展与土地资源保护的矛盾、地方土地信访工作具体方法存在缺陷、权力救济途径不畅。最后,本文针对以上问题提出了完善建议,即必须完善现有土地信访制度,如丰富大信访机制、明确国土资源部门的地位、实现土地信访与司法救济途径的衔接、完善用地审查、提高经济补偿标准等等,同时还要完善地方土地信访工作的具体工作方法,比如强化责任、实行"重点管理"制度、加强土地信访处置追踪力度、提升土地信访工作信息化水平、增强依法用地的理念、加大对领导干部和信访部门的问责和监督力度等。
[Abstract]:Urbanization promotes the rapid transformation and change of Chinese society, which results in a lot of social contradictions, especially the problems arising from the rural collective land expropriation. In the process of rural collective land expropriation, illegal land use, land requisition compensation, ownership disputes occur frequently, which also leads to the high number of land related letters and visits in recent years, resulting in a lot of negative effects. Based on this background and the author's experience in land petition work in N city of Jiangsu Province, this paper studies the present situation of land petition work in China at the national and local levels, and tries to put forward some suggestions to improve the land petition work. This paper first studies the theory of land petition and visits, discusses and defines the concepts of petition and land petition, and explains the supposed state of land petition from the angle of social conflict theory and public governance theory. That is, the information feedback of public administration of land petition, the channel of right relief and democratic participation in politics, whose core function is to maintain the public ownership of land and serve the socialist economic construction. After that, this paper reveals the present situation of land petition and visits in our country, and compares it with the ought state of land petition, in order to highlight the current problems of land petition and visit: first, at the national level, the system of land petition and visit is basically formed. The main purpose of land petition and visit is becoming more and more, and there are many ways of land petition, which reflect the problem. Secondly, at the local level, through the analysis of a series of data and cases of land petition in N City of Jiangsu Province, It can be seen that the work of land petitions and visits in local areas is heavy, that repeated visits and visits are common, that the jurisdiction of land petitions and visits is extremely complex, and that the information construction of land letters and visits is insufficient and the strength of the work force is weak. The implementation of the land petition system has brought great obstacles. Finally, this paper analyzes the causes of the above problems, including: imperfect land petition system, the contradiction between the local government economic development and land resources protection, the defects of the specific methods of local land petition work, and the lack of power relief. Finally, this paper puts forward some suggestions for the above problems, that is, we must perfect the existing land petition system, such as enriching the large petition mechanism, clarifying the status of the land resources department, and realizing the link between the land petition and the judicial remedy. Improve land use review, raise economic compensation standards, and at the same time improve the specific working methods of local land petition and visit work, such as strengthening responsibility, implementing the "key management" system, and strengthening the tracking of land petition disposal, Improve the information level of land petition work, strengthen the concept of land use according to law, and strengthen the accountability and supervision of leading cadres and petition departments.
