江苏海事局基层执法机构设置与人员配备标准研究

【摘要】:行政体制是国家体制的重要组成部分,行政体制改革是全面深化改革的关键环节。伴随经济体制、政治体制、文化体制、社会体制等改革的不断推进,行政体制改革不断深化,取得了显著成效。十七大报告中谈到坚定不移发展社会主义民主政治时指出:“加快行政管理机制改革,建设服务型政府”,“服务型政府”一词首次写入党的报告,标志着服务型政府已经成为中国行政管理机制改革的建设目标。十八大强调,行政体制改革是推动上层建筑适应经济基础的必然要求。要按照建立中国特色社会主义行政体制目标,深入推进政企分开、政资分开、政事分开、政社分开,建设职能科学、结构优化、廉洁高效、人民满意的服务型政府。2013年直属海事系统开展了 “三定”工作,各级机构的内设机构设置基本完善,基层执法机构的设置和人员编制在“三定”中有所变化,但基层一线派出机构和办事站点的设置基本维持了水监体制改革的初期规模。为了进一步推进转化政府职能、简政放权的行政审批制度改革,2015年交通运输部海事局决定取消船舶进出港签证。由于海事基层执法机构的设置多年未进行调整,导致目前“三定”后基层执法机构设置与签证取消、海事监管重心向事中事后转变等新要求不完全匹配、人员配置不尽合理,对外造成工作不畅,对内制约海事业务工作正常开展。此外,推进依法治国、简政放权和海事“三化”建设也对基层执法机构如何适应新的形势,高效运转,有效履职,更好地提供优质的海事公共服务也提出了新的要求。面对持续推进简政放权、放管结合、优化服务,不断提高政府效能和取消船舶进出港签证、执法资源向基层一线倾斜、监管重心向事中事后转变等新形势,江苏海事局如何依托基层海事执法机构的设置和人员配置实现有效监管,提供优质的海事公共服务,值得研究。本文从公共管理的视角,运用行政体制和公共人力资源管理理论成果,探讨如何提升基层执法机构有效履职能力,提供优质的海事公共服务。通过分析江苏海事局基层执法机构设置与人员配备标准存在的问题,对海事处、直属办事处业务工作影响因素的统计分析,参考专家调查问卷结果,通过综合各类影响因素的加权计算平衡,制定了基层执法机构的机构设置标准,前瞻性地探索船舶签证取消后基层执法机构可能面临的调整,形成四类不同的基层执法机构标准,并通过一系列运行机制予以保障。在对基层执法机构进行分类定级的基础上,按照人员履职分工进行职位设置,参考借鉴直属海事系统沿用的有关基层执法机构机构编制和配布条件及设施设备配备标准中对机构设置、人员编制的测算方法,结合基层执法机构职位设置,侧重建立人员配备模型公式和弹性调整方法,按照四类基层执法机构研究设计了基层执法机构的岗位设置和人员配备标准。
[Abstract]:The administrative system is an important part of the national system, and the reform of the administrative system is the key link to deepen the reform in an all-round way. With the development of economic system, political system, cultural system and social system, the reform of administrative system has been deepened and achieved remarkable results. The report of the Seventeenth National Congress on unswervingly developing socialist democratic politics pointed out: "speeding up the reform of the administrative mechanism and building a service-oriented government," and the term "service-oriented government" is for the first time written into the party's report. Service-oriented government has become the goal of administrative mechanism reform in China. The 18th National Congress stressed that the reform of the administrative system is an inevitable requirement for the superstructure to adapt to the economic base. In accordance with the goal of establishing a socialist administrative system with Chinese characteristics, we must further promote the separation of government and enterprise, separation of government from capital, separation of government from affairs, separation of government and social affairs, scientific construction functions, optimization of structure, and integrity and efficiency. A service-oriented government that is satisfied with the people. In 2013, the maritime system directly under its authority launched the work of "three regulations," and the internal establishment of institutions at all levels was basically improved, and the setting up and staffing of law enforcement agencies at the grass-roots level changed in the "three regulations." But the establishment of grass-roots field offices and offices basically maintained the initial scale of water supervision system reform. In order to further promote the transformation of government functions and the reform of administrative examination and approval system of decentralization, the Maritime Affairs Bureau of the Ministry of Communications and Transport decided to cancel the entry and exit visas of ships in 2015. Since the establishment of the basic maritime law enforcement agencies has not been adjusted for many years, the new requirements of setting up and cancelling visas for the grassroots law enforcement agencies after the "three orders", changing the focus of maritime supervision to the post event, and so on, are not fully matched, and the staffing is not entirely reasonable. Foreign causes work unobstructed, restricts the maritime business work to carry out normally. In addition, to promote the rule of law, simplify the administration of power and maritime "three" construction also put forward new requirements for grass-roots law enforcement agencies how to adapt to the new situation, efficient operation, effective performance of their duties, and better provide high-quality maritime public services. In the face of the new situation of continuously promoting the decentralization of government power, combining release with management, optimizing services, continuously improving government efficiency and cancelling entry and exit visas for ships, tilting law enforcement resources to the grass roots, and shifting the focus of supervision to the post event, and so on, It is worth studying how Jiangsu Maritime Safety Bureau relies on the establishment and staffing of the basic maritime law enforcement agencies to achieve effective supervision and provide high-quality maritime public services. From the perspective of public management, this paper discusses how to improve the ability of law enforcement agencies at the grass-roots level to carry out their duties effectively and to provide high-quality maritime public services by using the administrative system and the theoretical achievements of public human resources management. By analyzing the problems existing in the establishment and staffing standards of the basic law enforcement agencies of Jiangsu Maritime Affairs Bureau, and the statistical analysis of the factors affecting the operational work of the Marine Department and the directly affiliated offices, and referring to the results of the expert questionnaire, By synthesizing the weighted calculation and balance of all kinds of influence factors, we have formulated the standards for setting up the law enforcement agencies at the grass-roots level, and have prospectively explored the adjustments that may be faced by the law enforcement agencies at the grass-roots level after the cancellation of ship visas. Form four different basic law enforcement standards, and through a series of operational mechanisms to ensure. On the basis of classifying and classifying the law enforcement agencies at the grass-roots level, and according to the division of duties and responsibilities of personnel, Referring to the calculation methods for the establishment and staffing of institutions and personnel in the standards for the establishment and distribution of basic law enforcement agencies and the equipment and equipment used by the maritime system directly under it, and combining with the establishment of posts in the grass-roots law enforcement agencies, The establishment of staffing model formula and flexible adjustment method are emphasized. According to the four kinds of basic law enforcement agencies, the post setting and staffing standards of the basic law enforcement agencies are designed.
