简政放权视阈下地方政府的自利性行为及其规制之道

【摘要】：实现社会公共利益最大化、为社会提供公共物品、使社会治理走向善治,是政府职能的核心内容,也是政府公利性的重要体现,更是构建法治型政府的本质属性。与此同时,政府也是一个理性"经济人",难免会追求自身利益的最大化,即存在着自利性行为。全面深化改革的关键期,一方面,简政放权背景下地方政府享有更多的自主决定权;另一方面,地方政府自主决定权增加后,受利益驱动,必然产生乃至扩大不合理的政府自利行为。充分了解地方政府自利性行为的基本特征和表现形式,提出行之有效的规制方法尤为重要。法律规范、道德规范、技术规范三者并举是规制地方政府不合理自利行为的关键。
[Abstract]:To realize the maximization of social public interest, to provide public goods for the society and to make the social governance move towards good governance are the core contents of the government's functions, as well as the important embodiment of the government's commonality, and the essential attribute of constructing the rule of law government. At the same time, the government is also a rational "economic man", it will inevitably pursue the maximization of its own interests, that is, the existence of self-interest behavior. In the critical period of comprehensive deepening reform, on the one hand, local governments have more independent decision-making power under the background of decentralization; on the other hand, local governments are driven by interests after the increase of autonomous decision-making power. It is inevitable to produce and even expand unreasonable government self-interest behavior. It is very important to fully understand the basic characteristics and forms of self-interest behavior of local government and put forward effective regulation methods. It is the key to regulate the unreasonable self-interest behavior of the local government that the legal standard, the moral standard and the technical standard go hand in hand.
