【摘要】：行政审批制度改革一直是我国行政体制改革中的热点问题,是完善社会主义市场经济体制、处理好政府与市场关系的重要内容,它在构建“廉洁、勤政、务实、高效”的服务型政府中有着非常重要的作用。十八届三中全会报告提出要“深化行政审批制度改革”,行政审批制度改革是未来政府工作的重点内容。改革开放以来,随着市场化程度的不断加深,市场在资源配置中的作用不断加大,如何充分发挥市场在资源配置中的决定性作用,就要正确处理政府和市场的关系。因此,减少政府的行政审批权,大力实施简政放权,继续深入推进行政审批制度改革,逐步建立和完善与市场经济发展相适应的行政审批制度,是未来行政体制改革中一项常抓不懈的工作。自从2001年开展行政审批制度改革工作以来,甘肃省认真贯彻落实中央决策部署,按照中央统一安排,以行政审批制度改革为抓手,以转变政府职能为核心,大力简政放权,不断深化行政体制改革,取得了巨大成效。但是长期以来,由于行政管理理念落后、政府职能转变滞后、行政程序法律体系不健全、部门利益的影响等原因,甘肃省在行政审批制度改革中依然存在效率低下、权力下放主动性不高和监管不到位等问题,甘肃省与党中央和一些发达兄弟省份的改革工作还存在一定差距。基于此,研究甘肃省行政审批制度的改革历程及现状,进一步完善甘肃省行政审批制度,对于发展甘肃社会经济、提高公共服务水平、方便人民群众具有极其深远的意义。论文从行政审批制度的理论基础着手,对甘肃省行政审批制度改革实践进程、改革中存在的问题以及存在问题的原因等方面的资料进行了整理分析,并针对存在的问题,进一步探讨了完善甘肃省行政审批制度的路径,以期建立起适应社会主义市场经济体制的行政审批制度。论文的具体结构如下:第一章,绪论部分,分析了论文的研究缘起及意义,并阐述了国内外研究现状、论文采用的研究思路与方法,最后提出了论文的研究重点、难点以及创新点。第二章,阐述了行政审批制度的理论基础及其演进,包括行政审批的内涵界定及相关理论支持,主要支撑理论有政府管制理论、服务型政府理论和政府流程再造理论。第三章,主要采用历史的分析方法,对甘肃省行政审批的实践进程做一梳理和分析,对每一个历史时期的大环境和行政审批的特征进行归纳总结,展现出甘肃省在行政审批制度改革中不断努力探索、逐步完善行政审批制度的动态过程。第四章,依据前文的研究方法和理论基础,通过搜集、整理大量文献资料以及部分统计数据,分析了甘肃省的行政审批现状,对当前甘肃省行政审批已取得的成效、存在的问题以及存在问题的原因进行了探讨和总结。第五章,针对前文所分析的甘肃省行政审批存在的问题,以国务院、党中央以及甘肃省省委、省政府关于行政审批制度改革的相关法律法规、政策及文件为主要依据,积极贯彻国务院、党中央的整体部署,结合甘肃省实际状况,提出了完善甘肃省行政审批制度的具体路径。具体而言,就是加快政府职能转变,深入推进行政审批改革工作;加强社会组织规范化建设,进一步强化政府监管力度;规范行政审批行为,推进审批方式和管理体制创新;继续深入推进简政放权,厘清政府与市场边界;健全行政审批机制,完善行政审批体系等。
[Abstract]:The reform of the administrative examination and approval system has always been a hot issue in the reform of the administrative system in China. It is an important content of perfecting the socialist market economy system and dealing with the relationship between the government and the market. It has a very important role in building a "clean, diligent, pragmatic and efficient" service-oriented government. The report of the third Plenary Session of the 18th CPC Central Committee is "deep". Since the reform and opening up, with the deepening of the market level, the role of the market in the allocation of resources is increasing. In the third chapter, the third chapter mainly adopts the historical analysis method to analyze and analyze the practice process of administrative examination and approval in Gansu Province, summarizes the characteristics of the great environment and administrative examination and approval in every historical period, and shows that Gansu province is constantly trying to explore the reform of administrative examination and approval system. In the fourth chapter, according to the research method and theoretical basis of the previous article, through collecting, sorting out a large number of documents and some statistical data, the present situation of administrative examination and approval in Gansu province is analyzed.
