我国公务员行政惩戒制度的现状、问题及对策研究

【摘要】:公务员作为依法治国的主体,行使人民赋予的公共权力管理国家事务。我国公务员制度的建立,是为了适应社会主义市场经济发展而对我国干部人事制度实行重大改革的结果。尤其是2006年1月1日起,《中华人民共和国公务员法》正式施行,标志着我国公务员管理进一步向科学化、法制化发展,着眼于建立一支高素质、专业化的公务员队伍。但是由于我国公务员制度还比较年轻,加之传统思想的影响,相关配套制度还不够完善。本文就是在这样的现实情况下,受当前党的群众路线教育实践活动、反腐高压态势的启发,对我国公务员行政惩戒制度进行了深入思考,运用比较研究、理论研究和案例分析等方法,通过对国内外研究现状的阐释,对如何完善我国公务员行政惩戒制度提出有价值的建议。公务员行政惩戒制度的内涵,是指国家公务员管理机关,对违法失职但免于刑事处罚的公务员,给予一定的惩罚、申诫、救济的一系列法律规范、制度的总称,具有惩戒主体唯一、惩戒对象特定、惩戒功能的双重性、惩戒的目的在于教育四个特征,其一般理论有公共服务理论、权利保障理论和行政法治理论。我国公务员行政惩戒制度经历了初步建立、曲折发展、毁坏、恢复并发展、全新发展等历程,虽然较之以前有了一定程度的完善,但在行政惩戒种类、形式、程序、救济程序四个方面存在不足,需要进一步完善。为汲取国外公务员行政惩戒制度的经验,对各国公务员行政惩戒制度进行了较为详细的阐述。得出国外公务员行政惩戒制度有五个特点:对法律的信仰多过外在的约束、惩戒形式多样、惩戒机关双轨、提供充分权益保障、惩戒程序具有“司法性”倾向,对我国的启示有:我国公务员行政惩戒制度应高度规范化、应建立相对独立的公务员惩戒救济机构、惩戒形式应多样化、程序应进一步完善、惩戒程序“审判化”。既对违纪公务员进行依法惩戒,又更加重视保障公务员的合法权益,这是文章的出发点和立足点。对于如何完善我国公务员行政惩戒制度,得出了四点创新建议。健全我国公务员行政惩戒种类,加强立法保障;丰富我国公务员行政惩戒方式,坚持多管齐下;严格我国公务员行政惩戒程序,接受公众监督;完善我国公务员行政救济制度,保障公务员合法权益。本文旨在对我国公务员行政惩戒制度的现状、问题及原因分析的基础上,提出完善制度的可行方法,从而不断深化惩戒的内涵,不断注重保障公务员合法权益,不断融洽党群、干群关系,不断加强我国公务员队伍建设,不断夯实治国理政的基础。
[Abstract]:As the subject of governing the country according to law, civil servants exercise the public power conferred by the people to manage state affairs. The establishment of the civil service system in China is the result of the major reform of the cadre and personnel system in order to adapt to the development of the socialist market economy. Especially since January 1, 2006, the Civil servant Law of the people's Republic of China has been put into effect formally, which marks the further development of the management of civil servants in our country in a scientific and legalized way, with a view to establishing a high-quality and specialized civil service. But because our civil service system is still relatively young, coupled with the influence of traditional ideas, the relevant supporting system is not perfect. This paper, inspired by the Party's current mass line education practice and the high pressure situation of anti-corruption, has made a deep thinking on the administrative disciplinary system of civil servants in our country and made a comparative study on it under such a realistic situation. By means of theoretical research and case analysis, this paper puts forward some valuable suggestions on how to perfect the administrative disciplinary system of civil servants in China through the explanation of the present research situation at home and abroad. The connotation of the administrative disciplinary system of civil servants refers to a series of legal norms and system that the civil servants who violate and neglect their duties but are exempted from criminal punishment are given a series of punishment, admonitions and remedies. There are four characteristics of discipline: the only subject of discipline, the specific object of discipline, the dual nature of disciplinary function, and the purpose of discipline is education. The general theories include public service theory, right guarantee theory and administrative rule of law theory. The administrative disciplinary system of civil servants in our country has gone through the initial establishment, tortuous development, destruction, restoration and development, new development and so on. Although it has a certain degree of perfection compared with before, but in the types, forms, procedures of administrative discipline, There are four deficiencies in the relief procedure, which need to be further improved. In order to draw on the experience of administrative disciplinary system of foreign civil servants, the administrative disciplinary system of civil servants in various countries is elaborated in detail. It is concluded that the administrative disciplinary system of foreign civil servants has five characteristics: the belief in the law is more than the external restraint, the forms of discipline are various, the disciplinary organs have dual tracks, provide adequate protection of rights and interests, and the disciplinary procedure has the tendency of "judicial nature". The enlightenment to our country is: our country civil servant administrative discipline system should be highly standardized, should establish relatively independent civil servant disciplinary relief organization, the disciplinary form should be diversified, the procedure should be further improved, the disciplinary procedure should be "tried". It is the starting point and foothold of the article to punish civil servants in violation of discipline according to law and pay more attention to protecting the legitimate rights and interests of civil servants. As to how to perfect our civil servant administrative disciplinary system, four innovative suggestions are obtained. Improve the types of administrative discipline of civil servants in China, strengthen the legislative protection; enrich the mode of administrative discipline of civil servants in China, adhere to the multi-pronged approach; strictly enforce the administrative disciplinary procedures of civil servants in China, accept public supervision; improve the administrative relief system for civil servants in China. Protect the legitimate rights and interests of civil servants. Based on the analysis of the present situation, problems and causes of the administrative disciplinary system of civil servants in China, this paper puts forward some feasible methods to perfect the system, so as to deepen the connotation of the disciplinary system, pay more attention to the protection of the legitimate rights and interests of civil servants, and harmonize with the Party and the masses. The relationship between cadres and the masses constantly strengthens the construction of our civil servants and constantly solidifies the foundation of governing the country.
