当代中国行政问责体系构建问题研究

【摘要】:行政问责制作为一种加强权力和制约的现代民主制度,成为中国民主政治发展和行政管理体制改革的热点问题。时至今日,我国的行政问责理论已日臻成熟,行政问责实践业已初见成效。然而,取得成绩的同时我们也不能忽略行政问责体系在我国实际运行中所显现出的一些问题。我们对行政问责体系的构建进行更深入的研究有助于实现对政府的行政权力的监督与制约,同时对于促进我国的责任政府建设、政治文明建设、丰富权力监督与制约理论都具有十分重要的意义。本文从民主政治条件下的权力监督与制约视角分析我国行政问责发展过程中存在的问题及归因,力求构建有效的行政问责运行体系。分析国内外研究的主要成果、观点、分歧及存在的主要问题。基于文献分析的研究方法,梳理并辨析行政问责相关的概念及基本理论,为行政问责体系的构建提供理论依据。对当代中国的发展历程进行历史性地考察。从建国初期行政问责思想的萌芽到十一届三中全会后的行政问责初步确立,及至2003年之后行政问责实践的全面推行与逐渐完善。对我国当代行政问责体系的发展进行历史性地分析,以获取构建我国行政问责体系的重要启示。我国行政问责体系在发展及构建过程中仍存在诸多问题,如问责主体的缺失致使偏重同体问责、问责客体的权责与职能过于笼统致使客体责任不清、问责范围不够广泛致使问责内容狭窄、问责程序的设计不够健全致使运行不规范、问责结果的处理不透明等等。存在上述问题的主要原因有缺乏问责意识、政务公开不透明、问责制度不完善、问责机制不健全等。针对我国行政问责体系存在的问题及原因,提出构建并完善我国行政问责体系的对策。要健全行政问责主体体系,使各主体间形成问责合力,规范行政问责程序实现问责的制度化和规范化、完善行政问责救济机制保障行政问责客体的合法权益,完善官员复出机制避免人才资源浪费。行政问责体系的构建与有效运行,可以为行政问责制的发展给予协助。
[Abstract]:As a modern democratic system which strengthens the power and restriction, the administrative accountability system has become a hot issue in the development of democratic politics and the reform of administrative management system in China. Today, the theory of administrative accountability in our country has matured, and the practice of administrative accountability has achieved initial results. However, at the same time, we can not ignore some problems in the actual operation of administrative accountability system. A more in-depth study on the construction of administrative accountability system will help us to supervise and restrict the administrative power of the government, and at the same time, to promote the construction of responsible government and political civilization in our country. It is of great significance to enrich the theory of power supervision and restriction. From the perspective of power supervision and restriction under the condition of democratic politics, this paper analyzes the existing problems and attribution in the development of administrative accountability in China, and tries to build an effective system of administrative accountability. Analyze the main research achievements, viewpoints, differences and existing problems at home and abroad. Based on the research methods of literature analysis, this paper combs and discriminates the related concepts and basic theories of administrative accountability, and provides the theoretical basis for the construction of administrative accountability system. To the contemporary China's development course carries on the historical inspection. From the beginning of the founding of the people's Republic of China, the idea of administrative accountability was initially established after the third Plenary session of the Eleventh Central Committee, and the practice of administrative accountability was carried out and gradually perfected after 2003. This paper makes a historical analysis of the development of our country's contemporary administrative accountability system in order to obtain the important enlightenment of constructing our country's administrative accountability system. There are still many problems in the process of development and construction of the administrative accountability system in China, such as the lack of the subject of accountability leads to the emphasis on the accountability of the same body, the responsibility and function of the object of accountability is too general to make the responsibility of the object unclear. The scope of accountability is not wide enough, the content of accountability is narrow, the design of accountability procedure is not perfect and the operation is not standardized, the handling of accountability results is not transparent and so on. The main reasons for these problems are lack of accountability consciousness, opaque government affairs, imperfect accountability system, imperfect accountability mechanism and so on. Aiming at the problems and reasons of administrative accountability system in our country, the countermeasures of constructing and perfecting administrative accountability system in China are put forward. It is necessary to perfect the system of the subject of administrative accountability, to form a joint force of accountability among the subjects, to standardize the procedure of administrative accountability to realize the institutionalization and standardization of accountability, and to perfect the relief mechanism of administrative accountability to protect the legitimate rights and interests of the object of administrative accountability. To improve the mechanism for the return of officials to avoid the waste of human resources. The construction and effective operation of administrative accountability system can assist the development of administrative accountability system.
