论开放式行政问责制

【摘要】：行政问责制自2003年SARS事件之后成为我国社会和学术界议论、研究的热点。十余载过去,学术专著、学术论文可谓汗牛充栋,行政问责事件也层出不穷,但我国行政问责制仍未以完整体系进行构建,有关问责的规定也是散见于多部法律、多种规定中,无法“拧成一股绳”。学术研究大相径庭,有关行政问责制的核心问题研究遇到了瓶颈,所以为我国行政问责制找到一个核心点是本文的主要研究目的。本文分为六个部分。绪论部分介绍了本文的研究背景和研究意义,以及国内外行政问责制的研究现状,并列明了本文的研究方法和创新之处。第一章首先厘清行政问责制涉及的基础概念,包括行政权力和行政责任的概念以及两者之间的关系,行政问责制的概念及构成。第二章对我国行政问责制的发展历程进行了梳理,以期达到以史为鉴的目的。第三章从我国行政问责的现状出发,归纳出我国行政问责实践中存在的问题并分析其原因。第四章结合行政问责制的理论基础和近年来我国党中央、国务院有关行政问责的重要文件,找出我国行政问责制度构建的核心点,提出开放式行政问责制这一设想并对其进行定义。第五章是本文的精华所在,即围绕“开放式”这一核心来为我国行政问责制的构建与完善提出可行建议,包括问责主体的多元性构建、问责客体的明确性构建、问责程序的透明性构建、问责法律的统一性构建。
[Abstract]:The administrative accountability system has become a hot topic in our society and academic circles since the SARS incident in 2003. In the past ten years, academic monographs and academic papers have been full of money, and administrative accountability incidents have emerged in endlessly. However, the administrative accountability system in our country has not yet been constructed with a complete system, and the provisions on accountability are scattered in many laws and regulations. Can't "twist a rope". Academic research is quite different, the research on the core issues of administrative accountability system has encountered a bottleneck, so the main purpose of this paper is to find a core point of administrative accountability system in our country. This paper is divided into six parts. The introduction part introduces the research background and significance of this paper, as well as the current research situation of administrative accountability system at home and abroad, and makes clear the research methods and innovations of this paper. The first chapter clarifies the basic concepts of administrative accountability system, including the concept of administrative power and administrative responsibility and the relationship between the two, the concept and composition of administrative accountability system. The second chapter combs the development course of China's administrative accountability system, in order to achieve the purpose of learning from history. The third chapter summarizes the problems existing in the practice of administrative accountability in China and analyzes the reasons for it from the point of view of the present situation of administrative accountability in our country. The fourth chapter combines the theoretical basis of the administrative accountability system and the important documents of the CPC Central Committee and the State Council on administrative accountability in recent years to find out the core points of the construction of the administrative accountability system in China. Put forward the idea of open administrative accountability system and define it. The fifth chapter is the essence of this paper, that is, around the core of "open" to put forward feasible suggestions for the construction and improvement of administrative accountability system in China, including the pluralistic construction of the accountability subject and the clear construction of the accountability object. The construction of transparency of accountability procedure and the unity of accountability law.
