论我国行政审批制度改革中的问题及其对策

【摘要】：行政审批制度改革是当下的热点,十八届三中全会公布《中共中央关于全面深化改革若干重大问题的决定》和2014年的中国行政法学研究会年会都把行政审批制度的改革作为其中一个重要的议题。行政审批制度及其改革的效果在处理政府和社会、申请人的关系上没有达到平衡,就需要不断地探索深化。研究行政审批制度改革可以为当今深化改革的实践提供更为系统、丰富的理论基础。虽然对于行政审批制度及其改革的理论确实不少,但是经历了这么多年的改革后,行政审批制度改革的现状、问题也已经发生了很大的变化,继续以以往的理论、方法支撑当下的改革,难免捉襟见肘,影响改革的成效。况且,也存在着部分研究主题和内容不一致的情形,把行政审批的问题和行政审批改革的问题作为同一个概念理解。只是把行政审批制度存在的问题分析全面,而改革的问题及解决对策却并没有触及。基于这些的背景下,以行政审批制度的改革为研究对象就显得很重要。本文正是以动态的改革作为论述的视角,辅以静态的行政审批制度的基本理论,对行政审批制度改革存在的问题及其致因进行分析,为我国改革的深化提出有针对性、务实的对策。本文在结构上主要包含了这些模块:引言、我国行政审批制度改革的理论概述和历史进程、我国行政审批制度改革中的问题及其致因、国外行政审批制度改革的实践及其启示以及深化我国行政审批制度改革的对策、结语。
[Abstract]:The reform of the administrative examination and approval system is a hot spot at present. The third Plenary session of the 18th CPC Central Committee announced the decision of the CPC Central Committee on comprehensively deepening the reform of several major issues, and the annual meeting of the China Association of Administrative Law Studies in 2014 all made the reform of the administrative examination and approval system one of the important topics. The effect of administrative examination and approval system and its reform in dealing with the relationship between government and society and the applicant has not reached a balance, so it is necessary to continuously explore and deepen the relationship between the administrative examination and approval system and its reform. The research on the reform of the administrative examination and approval system can provide a more systematic and rich theoretical basis for the practice of deepening the reform. Although there are many theories about the administrative examination and approval system and its reform, but after so many years of reform, the current situation of the reform of the administrative examination and approval system has also undergone great changes and continues to be based on previous theories. Methods to support the current reform, inevitably overstretched, affecting the effectiveness of the reform. Moreover, there are some different subjects and contents of the research, and the problems of administrative examination and approval and the reform of administrative examination and approval are understood as the same concept. The problems existing in the administrative examination and approval system are analyzed comprehensively, but the reform problems and solutions are not touched. Based on these background, it is very important to study the reform of administrative examination and approval system. This article takes the dynamic reform as the angle of view, complements with the static administrative examination and approval system basic theory, carries on the analysis to the administrative examination and approval system reform existence question and its cause, for our country reform deepening proposed has the pertinence, A pragmatic response. The structure of this paper mainly contains these modules: introduction, the theoretical overview and historical process of the reform of administrative examination and approval system in China, the problems in the reform of administrative examination and approval system of our country and the causes thereof. The practice and enlightenment of the reform of administrative examination and approval system abroad and the countermeasures to deepen the reform of administrative examination and approval system in our country.
